This is a case about whether Cambridge Industries, Inc., violated the Americans with Disabilities Act of 1990 (ADA) by rejecting otherwise qualified workers based on results from a pre-employment nerve condition test meant to check for carpal tunnel syndrome and similar conditions. On July 20, 1998, the United States Equal Employment Opportunity Commission (EEOC), on behalf of 16 individuals not hired as a result of the nerve condition test, filed this lawsuit in the U.S. District Court for the Northern District of Illinois. The EEOC sued Cambridge Industries, Inc., along with Local 1766 United Automobile, Aerospace and Agricultural Implement Workers of America and International Union, United Automobile, Aerospace and Agricultural Implement Workers of America, pursuant to 42 U.S.C. § 12101. The EEOC claimed that Cambridge’s practice of requiring a nerve conduction test for all entry level positions requiring repetitive or continuing motion and/or constant use of vibratory power tools led to their unsuccessful applications because Cambridge perceived or regarded them as having an impairment that substantially limited them in the major life activity of working.

Originally assigned to Judge Joan B. Gottschall, the case was reassigned to Judge Robert W. Gettleman on August 31, 1998 because of its relation to an ongoing case: EEOC v. Rockwell Int’l Corp (No. 1:95-cv-3824). Rockwell was the previous owner of the facility now owned and operated by Cambridge, and in 1995, Rockwell had been sued by the EEOC on the exact same grounds as in this case.

After a year of discovery, Cambridge filed a motion for summary judgement on October 26, 1999. Plaintiffs responded by filing two motions for partial summary judgment. However, on August 29, 2000, Judge Gettleman granted Cambridge’s motion for summary judgement. 2000 WL 1458808. First, he noted that the court had granted summary judgment to Rockwell on August 13, 1999, “holding that plaintiff had failed to present any evidence that Rockwell perceived the claimants as disabled within the meaning of the ADA.” Rockwell Int’l, 60 F. Supp. 2d 791. He concluded that the plaintiffs’ allegations in this case suffered from the same fatal flaw. While the plaintiffs had sought to bring in an additional, unique expert report to support their claim in this case, Judge Gettleman ruled that the report was inadmissible based on irrelevance.

The plaintiffs appealed to the Seventh Circuit on October 19, 2000. The appeal was suspended on November 20, 2000 pending the Seventh Circuit's decision in Rockwell Int’l (Appeal No. 00-1897). Following the Seventh’s Circuit decision to uphold the summary judgment order in Rockwell on March 8, 2001, the Seventh Circuit dismissed the plaintiffs’ appeal on August 13, 2001.
