In June 1999, the Birmingham Office of the EEOC filed this lawsuit against Oak Mountain Energy, LLC in the U.S. District Court for the Northern District of Alabama. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. When the defendant failed to appear, the EEOC successfully motioned for a default judgment in March 2000. The EEOC motioned to dismiss the case without prejudice in July 2000 since the defendant filed for bankruptcy and the EEOC did not believe it would be worth the time and cost of proving damages in this case.
