The EEOC's Chicago office filed this suit in U.S. District Court for the Northern District of Illinois on September 29, 2003. The complaint alleged Whitehall Hotel and Whitehall Restaurant violated the Americans with Disabilities Act (ADA) by failing to accommodate a cook with a learning disability and by including impermissible inquiries on job applications regarding applicants' need for accommodations. After filing, both sides filed numerous discovery motions. The defendant filed a motion for summary judgment which was partially granted. The judgment would have prevented the EEOC from being granted injunctive relief at trial. However, the parties ended up settling the case, and a consent decree effective for three months was entered in September 2005 in which Whitehall agreed to pay its former cook $15,000 and conduct a training seminar for its managers.
