Case Summary

The New York District Office of the EEOC brought this action in the U.S District Court for the Northern District of New York, against J.S. Hunt Transport, Inc. The complaint was filed in October 1997 and in June 2000, the EEOC filed for summary judgment. Defendant cross-filed for summary judgment on the same day. In February 2001, the EEOC's motion for summary judgment was denied and Defendant's motion for summary judgment was granted, and the case was dismissed.

In April 2001, the EEOC filed notice of appeal, but in May 2003 the Order of the District Court for summary judgment was affirmed. In September of 2001 though, Defendant filed a motion for attorneys' fees in the amount of $299,342.19. The motion was granted in part and denied in part and Defendant was awarded $154,257.25 in attorneys' fees and $20,900.40 in litigation expenses for a total award of $175,157.65. However, the Court of Appeals reversed the award of attorneys' fees in February 2004.
