In April 2003, the Memphis office of the EEOC brought this suit against United Parcel Service et al in the U.S. District Court for the Eastern District of Tennessee. After the parties failled to reach a settlement through mediation, the defendant filed a motion for summary judgment in May 2004. The court granted summary judgment in favor of the defendant in September 2004. The EEOC filed a notice of appeal in November 2004 but voluntarily dimissed its appeal in February 2005.
