In September 1998 and Novermber 1999, a Muslim employee filed two charges with the Dallas district office of the EEOC against his employer, the Plano Independent School District (PISD), under Title VII, 42 U.S.C. § 2000e et seq. He alleged religious discrimination by the PISD.
In September 1999, the EEOC determined that a reasonable cause existed to believe that the PISD discriminated and retaliated against the complainant on the basis of his religion (Islam). Unable to secure a conciliation agreement, the EEOC referred the complaint to the DOJ.
In 2002, the United States, the complainant and the PISD entered into a settlement agreement. Under the agreement, the PISD was prohibited from discrimination and agreed to reasonable accommodation of good faith religious observances and practices. The PISD was required to conduct a mandatory anti-discrimination training within 180 days of the agreement for its supervisory personnel. It was required to implement a religious accommodation policy, that included, among others, a clear statement of complaints procedures and to distribute the policy among its employees. Additionally, the PISD agreed to pay the complainant $5,000.
