This is a case challenging House Bill 2443, which the Arizona Legislature passed on March 23, 2011. This is a case challenging House Bill 2443, which the Arizona Legislature passed on March 23, 2011. The act amended the Arizona abortion statute by prohibiting any person from knowingly: (1) providing an abortion to a woman seeking the procedure because she did not want to give birth to a child of a certain race or gender, (2) using force or threats to injure or intimidate a woman for the purpose of coercing a sex-selection or race-selection abortion, and (3) knowingly soliciting or accepting money to finance a sex-selection or race-selection abortion. The law imposed criminal liability and included a civil penalty provision allowing a woman’s husband or parents (if the woman was a minor) to recover against a physician who performed a sex-selection or race-selection abortion. Finally, the law required abortion providers to complete an affidavit prior to the procedure stating they were not providing the abortion because of the fetus’s race or sex.  

In response to this law, on May 29, 2013, the NAACP, Maricopa County Branch, and the National Asian Pacific American Women’s Forum filed a complaint in the U.S. District Court for the District of Arizona on behalf of themselves and their members. The plaintiffs sued the attorney general of Arizona in his official capacity, the Arizona Medical Board, and the executive director of the Arizona Medical Board in her official capacity. Represented by the ACLU of Arizona and the ACLU, the plaintiffs sought declaratory and injunctive relief, as well as costs and attorneys’ fees. The plaintiffs cited the legislative history of the law, which included Arizona legislators’ concerns, first, that Black women might be terminating their pregnancies because of their fetuses’ race and, second, that the increasing immigration of Asian and Pacific Islander women to Arizona would increase the use of sex-selection abortion within the state. The plaintiffs argued these racially motivated stereotypes about Black and Asian women’s reasons for terminating a pregnancy violated the Equal Protection Clause of the Fourteenth Amendment by stigmatizing the plaintiffs. 

The case was assigned to Judge Paul G. Rosenblatt, who immediately recused himself for unstated reasons. The case was then reassigned to Magistrate Judge Bridget S. Bade. 

On July 1, 2013, the Maricopa County attorney, Arizona Representative Steve B. Montenegro, and The Frederick Douglass Foundation moved to intervene as defendants to represent their interests in preserving the law. 

The following day, the parties elected to assign the case to a district judge, and the case was assigned to Judge David G. Campbell. 

Next, the defendants filed a motion to dismiss for lack of jurisdiction. The defendants alleged that the plaintiffs did not have Article III standing, because the law compelled identical treatment of all women and excluded pregnant women from liability. Thus, the plaintiffs’ sole harm was one of stigma, which the defendants alleged was insufficient to confer standing. Judge Campbell granted the defendants’ motion and dismissed the case for lack of standing on October 3, 2013. 2013 WL 5519514. He held that the plaintiffs failed to show they were personally denied equal protection of the law and that stigmatic injury did not confer standing. Accordingly, Judge Campbell simultaneously denied the motion to intervene as moot. 

The plaintiffs appealed in the U.S. Court of Appeals for the Ninth Circuit (13-17247). In addition to their previous arguments, the plaintiffs alleged on appeal that they had standing because they were the targets of discriminatory intent. On December 15, 2015, Judge Clifton, Judge Owens, and Judge Smith affirmed the district court and dismissed the lawsuit, holding the plaintiffs had merely repeated their stigmatic injury argument and did not have Article III standing. 626 F. App’x 200.
