Martin Walsh filed suit in his official capacity as the Secretary of Labor for the U.S. Department of Labor (DOL) against Packers Sanitation Services, one of the largest food safety companies in the U.S., in the U.S. District Court for the District of Nebraska on November 9, 2022. Martin Walsh filed suit in his official capacity as the Secretary of Labor for the U.S. Department of Labor (DOL) against Packers Sanitation Services, one of the largest food safety companies in the U.S., in the U.S. District Court for the District of Nebraska on November 9, 2022. DOL alleged that Packers illegally employed more than two dozen children, ranging in age from 13 to 17, in meatpacking plants in violation of the Fair Labor Standards Act.

DOL also filed a motion for a Temporary Restraining Order and Preliminary Injunction. On November 10, the case was assigned to District Judge John M. Gerrard. On November 10, the Court granted the temporary restraining order prohibiting Packers from employing oppressive chid labor and mandating that Packers and its employees comply with the DOL investigation and shall not destroy relevant information or documents after finding that the evidence presented suggested a strong likelihood of success on the claims that Packers unlawfully employed child laborers.

On November 21, 2022, Judge Gerrard partially granted defendant's request for expedited discovery. The Court ordered Plaintiffs to produce certain limited information - the identity of any minor still employed by Defendant and copies of any documents the defendants intended to present at the preliminary injunction hearing - but did not grant the full scope of discovery sought by defendants including additional names of minors alleged to be working in the plant. 

Defendants continued to seek expedited relief and both parties continued to file response briefs in the course of litigation. On December 5, 2022, DOL filed an unopposed motion for judgment by consent. The following day, on December 6, 2022, the court granted the consent decree. Per the terms of the consent decree, defendant was permanently enjoined from violating the FLSA and record to keep records of all employees under the age of 19 in accordance with the FLSA. In addition, within three months of the consent decree, defendant was required to hire a compliance specialist for a period of three years to provide training to management personnel and notify DOL of any suspect noncompliance. Audits of defendant's facilities made by the compliance specialist were required to be sent to DOL for three years. Among other conditions, the consent decree included a non-retaliation provision, including family members of minor children employed by defendant.
