This lawsuit, commenced on March 10, 2021, followed a Charge of Discrimination filed by the Disability Rights Advocates with the Equal Employment Opportunity Commission against the New York City Department of Education (NYCDOE) on May 6, 2020. The subsequent lawsuit in the U.S. District Court for the Southern District of New York on behalf of a public school teacher who alleged that the NYCDOE failed to provide her with necessary and reasonable accommodations. Specifically, the plaintiff alleged that she had been unable to use the restroom at the school she has worked at for the past thirteen years because the restroom did not accommodate her motorized wheelchair. The plaintiff also alleged that the NYCDOE denied her other necessary and reasonable accommodations, including an unobstructed evacuation space in case of an emergency and permission to allow her students to write in online journals because she was physically unable to carry seventy-five journals home. The plaintiff sought declaratory and injunctive relief, compensatory damages, and attorneys’ fees and costs for violations of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, and the New York City Human Rights Law (NYCHRL). U.S. District Judge John P. Cronan presided over this case. 

On November 17, 2021, the defendants served on the plaintiff an Offer of Judgment in favor of the plaintiff, under which the NYCDOE agreed to pay the plaintiff $50,001.00 in addition to attorneys’ fees, expenses, and costs. Pursuant to the Offer, the NYCDOE also agreed, inter alia, to provide the plaintiff with toilet seat riser chairs, to ensure that the school maintained an unobstructed evacuation space, and to allow her students to write in online journals. The plaintiff accepted, and on November 30, 2021, the court approved the Offer. This case is now closed.
