For the reasons stated at the hearing, Quest1 has not convincingly explained how the subjective, percipient testimony of the mediation attendee is plausibly relevant to the issues in this case. Additionally, the defenses contentions that those discussions are unprivileged and properly subject to discovery are untenable. The defense motion is denied; Plaintiffs request for a protective order is granted. Within seven days from the issuance of this order, Plaintiff will submit a competent declaration attesting to the fees and expenses incurred in the motion practice.
