In the aftermath of the Supreme Court’s 2022 Dobbs decision, the West Virginia legislature enacted the Unborn Child Protection Act (UCPA), which banned nearly all abortions regardless of the stage of pregnancy with only limited exceptions for nonviable fetuses and embryos, ectopic pregnancies, and medical emergencies. On January 25, 2023, GenBioPro, a company that manufacturers and sells a generic version of the abortion medication mifepristone, brought suit in the U.S. District Court for the Southern District of West Virginia against the State of West Virginia and the Putnam County prosecuting attorney under 42 U.S.C. § 1983. The plaintiff, represented by the Democracy Forward Foundation and private counsel, alleged that the UCPA, which severely restricts the market for mifepristone, interferes with the substantial and detailed federal regulatory program for drugs such as mifepristone established by the FDA. The plaintiffs also challenged earlier restrictions West Virginia had placed on the provision of mifepristone prior to enacting the UCPA, including a 24-hour waiting period, counseling requirements, and a prohibition on telemedicine prescriptions. While certain restrictions such as the waiting period and counseling requirements are no longer in effect because of the UCPA’s broader ban, they would be reinstated if the UCPA were ever struck down by a court. Other restrictions such as those on telemedicine prescriptions remain in effect even after the passage of the UCPA.

 

The complaint contained two counts:

  • Count I asserted that the UCPA and the earlier restrictions on mifepristone frustrate FDA’s determinations about how mifepristone should be regulated and invade an area Congress determined only FDA may occupy and as such federal law preempts their enforcement; and
  • Count II asserted that the UCPA and earlier restrictions violate the dormant Commerce Clause by interfering with the uniform regulation of mifepristone, a drug subject to extensive federal regulation at the national level, and thereby destroying the common market for the drug.

The plaintiff sought declaratory and injunctive relief. The case was assigned to District Judge Robert C. Chambers. This case was filed on the same day as a similar case, Bryant v. Stein, which challenged North Carolina's laws regulating mifepristone based on the same legal reasoning.

 

On February 16, 2023, the Putnam County prosecuting attorney filed a motion to dismiss for lack of jurisdiction and failure to state a claim. The state similarly filed a motion to dismiss on February 21st. Judge Chambers issued an order on May 2, 2023, denying the motions to dismiss as they pertained to standing and holding the remainder of the motions in abeyance. On August 24, 2023, Judge Chambers ruled on the remaining motions to dismiss, granting in part and denying in part the various motions. Specifically, concerning Count I, Judge Chambers denied the motion to dismiss relating to prior restrictions on prescribing mifepristone via telemedicine–holding that the restriction was “unambiguously preempted”–while dismissing the plaintiff’s claims relating to the UCPA and other prior restrictions. The court held that federal law did not preempt the UCPA and that it could issue no advisory opinion as to the constitutionality of the other prior restrictions because they are not currently in effect. Further, the court dismissed Count II of the complaint on the basis that “the Supreme Court and Courts of Appeals have repeatedly affirmed that morality-based product bans do not intrinsically offend the dormant Commerce Clause.”

 

The plaintiff filed an amended complaint on October 19, 2023, with little substantively changed from the initial complaint. Two weeks later, both parties submitted a joint stipulation that all claims in the amended complaint were decided in the court’s memorandum opinions and orders on the motions to dismiss, as well as a joint motion asking the court to issue a final judgment. Judge Chambers issued an order on November 6, 2023, dismissing the amended complaint and closing the case.

 

Following the closure of the case at the district court level, the plaintiff filed a notice of appeal to the U.S. Court of Appeals for the Fourth Circuit. The case is ongoing as of October 2024, with oral argument in the appeal scheduled for October 29th.
