Case Summary

This case challenged Tennessee’s ban on gender affirming care for minors. On March 2, 2023, Tennessee Governor Bill Lee signed into law a bill banning gender-affirming care for transgender patients under the age of 18. Specifically, Tennessee Senate Bill 1 (SB1) prohibited any “medical procedure” from being performed “for the purpose of . . .[e]nabling a minor to identify with” a gender identity different from the sex they were designated at birth or “[t]reating purported discomfort or distress…

This case challenged Tennessee’s ban on gender affirming care for minors. On March 2, 2023, Tennessee Governor Bill Lee signed into law a bill banning gender-affirming care for transgender patients under the age of 18. Specifically, Tennessee Senate Bill 1 (SB1) prohibited any “medical procedure” from being performed “for the purpose of . . .[e]nabling a minor to identify with” a gender identity different from the sex they were designated at birth or “[t]reating purported discomfort or distress from a discordance between the minor’s sex and asserted identity.” SB1 additionally required transgender youth currently receiving gender-affirming care to end that care by March 31, 2024. Further, SB1 established a private right of action against medical providers providing gender-affirming care to transgender youth.

On April 20, 2023, a 15-year-old and her parents, two other anonymous families, and a physician performing the medical procedures at issue sued several state officials in their official capacities under 42 U.S.C. § 1983 in the U.S. District Court for the Middle District of Tennessee to block SB1. Plaintiffs were represented by the American Civil Liberties Union, the ACLU of Tennessee, Lambda Legal, and Akin Gump Strauss Hauer & Feld LLP.

In their complaint, Plaintiffs brought four claims: First, Plaintiffs argued that SB1 would violate the Equal Protection Clause of the Fourteenth Amendment because it discriminated on the basis of sex and transgender status by prohibiting certain medical treatments only for transgender patients and only when those treatments were performed “for the purpose of . . . [e]nabling a minor to identify with, or live as,” a gender identity other than the sex designated at birth. Second, Plaintiffs claimed that SB1 would infringe on the fundamental rights of parents guaranteed by the Due Process Clause of the Fourteenth Amendment by preventing parents from seeking appropriate medical care for their children. Third, Plaintiffs asserted that SB1 was preempted by the federal Affordable Care Act’s prohibition against sex discrimination by healthcare programs and activities. Fourth, and relatedly, Plaintiffs argued that Defendants would violate the federal Affordable Care Act if they enforced SB1.

Plaintiffs sought a declaratory judgment on each of the above claims; preliminary and permanent injunctions enjoining Defendants from enforcing SB1; and costs and expenses, including reasonable attorneys’ fees. The day after the initial complaint was filed, Plaintiffs filed a motion for a Preliminary Injunction (PI).

On April 26, 2023, the United States Department of Justice (DOJ) filed a motion to intervene to join the lawsuit as a plaintiff, alleging that SB1 violated federal law. Judge Eli Richardson granted this motion on May 16, 2023, and the DOJ joined as an intervening plaintiff in this case.

Then, on June 28, 2023, the District Court granted in part Plaintiffs’ motion for a temporary injunction. First, the district court found that Plaintiffs had not established standing to challenge SB1’s ban of surgeries for gender dysphoria. 679 F.Supp.3d 668. However, the district court found that SB1’s ban on other medical procedures likely failed intermediate scrutiny: based on the record, the court held that SB1 was “severely underinclusive” because it banned the allegedly dangerous medical treatments for only the small fraction of minors who identified as transgender while leaving the procedures available for all other minors. As such, the ban was likely not substantially related to the state's asserted interest in generally protecting minors from the risks associated with the banned medical procedures.

Defendants appealed the District Court’s order to the U.S. Court of Appeals for the Sixth Circuit. On July 8, 2023, the Sixth Circuit stayed the District Court’s PI. 73 F.4th 408. In addition, they consolidated this appeal with the one of the preliminary injunction in Doe 1 v. Thornbury, a similar case in Kentucky in which seven transgender minors and their parents brought an action against state officials alleging that enacted legislation that prohibited the use of puberty-blockers and hormones for minors violated the Equal Protection Clause and Due Process Clause.

On September 28, 2023, the Sixth Circuit reversed the PIs in both this case and Doe 1 v. Thornbury. In its opinion, the Court questioned whether gender-affirming treatments adopted over the last few decades should be accepted as treatments for minors and argued that judges “should be humble and careful about announcing new substantive due process or equal protection rights that limit accountable elected officials from sorting out these medical, social, and policy challenges.” 83 F.4th 460.

Both the original individual plaintiffs and the DOJ filed a petition for certiorari with the U.S. Supreme Court on November 1, 2023, seeking review of the Sixth Circuit's decision. The Supreme Court agreed on June 24, 2024, to review the case (Docket No. 23-477), and heard argument on December 4, 2024. Attorneys for both the DOJ and the individual plaintiffs argued that SB1 discriminated against transgender youth based on their gender identity, which constituted sex discrimination under the Equal Protection clause.

On February 7, 2025, following Donald Trump's inauguration, the DOJ reversed its position in the case in a letter to the Court. The letter stated that SB1 does not deny equal protection, and as such the new administration would not have intervened to challenge the Tennessee law. Nevertheless, the DOJ urged the Supreme Court to resolve the question presented in this case without the need for re-briefing or re-hearing.

The Supreme Court issued its opinion on June 18, 2025. 145 S.Ct. 1816. In an opinion by Chief Justice Roberts (joined by the five other conservative justices), the Court affirmed the Sixth Circuit's ruling.  The majority opinion reasoned that Tennessee's ban on gender-affirming care for minors doesn't violate the Fourteenth Amendment's Equal Protection Clause because it doesn't explicitly classify by sex or transgender status, but rather by age (minority) and medical treatment type. So it requires only rational basis review. The State's concern about the safety of the banned treatment and the capacity of teenagers to consent to it were sufficiently rational to justify the ban. 

Justice Sotomayor dissented, joined by Justice Jackson stating that because SB 1 does classify individuals based on sex, the Court should use heightened scrutiny, and SB 1 would fail under heightened scrutiny. Justice Kagan joined most parts of Justice Sotomayor’s decision, but clarified that  she has no conclusion about whether SB 1 would satisfy heightened scrutiny.

Plaintiffs also filed a separate petition for writ of certiorari on November 1, 2023, asking the Supreme Court arguing that Tennessee’s SB1 violates the fundamental right of parents to make decisions concerning the medical care of their children guaranteed by the Due Process Clause of the Fourteenth Amendment. This petition was denied on June 30, 2025.

Back in the District Court, on July 9, 2025, Plaintiffs filed a notice that they were voluntarily dismissing their claims against all Defendants without prejudice; the Court dismissed the case the following day. The United States also filed a motion for voluntary dismissal.  The case is closed.
