On July 31, 2023, the US Department of Justice’s Civil Rights Division filed a lawsuit against the Alabama Department of Transportation (ALDOT) for violation of Title I of the Americans with Disabilities Act of 1990 in the District Court for the Northern District of Alabama Southern Division. The complaint alleged that ALDOT refused to re-hire a former employee because of his disability and instead hired a less experienced applicant. The DOJ sought declaratory and injunctive relief and backpay …

On July 31, 2023, the US Department of Justice’s Civil Rights Division filed a lawsuit against the Alabama Department of Transportation (ALDOT) for violation of Title I of the Americans with Disabilities Act of 1990 in the District Court for the Northern District of Alabama Southern Division. The complaint alleged that ALDOT refused to re-hire a former employee because of his disability and instead hired a less experienced applicant. The DOJ sought declaratory and injunctive relief and backpay and compensatory damages. 

The suit was brought on behalf of a complainant that filed a charge of discrimination with the Equal Employment Opportunity Commission on September 28, 2018. The Complainant was a person with a physical disability that restricted his ability to lift heavy objects. The disability was caused by a shoulder injury from an accident while working at ALDOT. The EEOC investigated the charge and found reasonable cause to believe that ALDOT discriminated against him and attempted then failed conciliation efforts.

On July 31, 2024, the DOJ moved for leave to amend the complaint to clarify the bases for its claim. Magistrate Judge Nicholas A. Danella denied the motion on October 8, 2024, holding that the proposed amendment was based on facts that were within the government’s knowledge before the deadline to amend had passed.

Both parties filed motions for summary judgment on November 22, 2024. Magistrate Judge Danella set a motion hearing for May 1, 2025. This case is ongoing.
