This case is about an employer’s obligation to accommodate an employee’s religious practice under Title VII of the Civil Rights Act of 1964. This case is about an employer’s obligation to accommodate an employee’s religious practice under Title VII of the Civil Rights Act of 1964. A United States Postal Service (USPS) worker who identified as an Evangelical Christian refused to work on Sundays in order to observe the “Lord’s Day.” He requested a complete exemption from Sunday work, which USPS did not grant. The agency instead allowed the postal worker to ask coworkers to swap shifts. The postal worker’s supervisors repeatedly disciplined him for refusing to work on Sundays; he resigned in January 2019. He sued USPS in the U.S. District Court for the Eastern District of Pennsylvania on May 1, 2019 under Title VII, alleging religious discrimination and a failure to accommodate for religious observance. Represented by Independence Law Center, Church State Council, and private counsel, the postal worker requested (1) a permanent injunction preventing USPS from religious discrimination, (2) an order requiring USPS to institute policies that allow religious observance on Sundays, (3) an order reinstating him to his former position, (4) money damages, and (5) attorneys’ fees. He filed an amended complaint on May 30, 2019, which modified the wording of the factual allegations.

USPS moved for summary judgment on February 14, 2020. On the same day, the postal worker moved for partial summary judgment on the failure to accommodate claim. On April 6, 2021, U.S. District Judge Jeffrey L. Schmehl granted summary judgment for the USPS. The court held that a religious accommodation does not need to wholly eliminate the conflict between work and a religious practice to be “reasonable.” Here, USPS’s offer to swap shifts was reasonable, even if it did not satisfy the postal worker. The court also held that USPS provided evidence that granting the postal worker’s requested accommodation would impose an “undue hardship” on the agency. It would violate the collective bargaining agreement and it would require the only other employee in the postal worker’s position to work every Sunday without a break. Thus, the court held that USPS could meet the 42 U.S.C. § 2000e(j) “undue hardship” exception from having to provide a reasonable accommodation, exempting it from liability under Title VII.

The postal worker appealed the district court’s decision on May 6, 2021. On January 25, 2022, the parties argued in front of a panel of judges from the U.S. Court of Appeals for the Third Circuit. The Third Circuit affirmed the district court’s decision to grant summary judgment for USPS on May 25, 2022. Writing for the panel, Circuit Judge Patty Shwartz held that reasonable accommodations under Title VII must eliminate the conflict between the postal worker’s religious practice and his work. USPS’s shift-swapping offer was not a reasonable accommodation because it did not eliminate this conflict. However, Judge Shwartz still found for USPS because the postal worker’s proposed accommodation (full exemption from Sunday work) would cause USPS “undue hardship.” Judge Thomas M. Hardiman dissented, arguing that USPS did not provide enough evidence of an undue hardship on its business to warrant summary judgment.

The postal worker asked the Supreme Court of the United States to hear the case on August 26, 2022. One month later, members of Congress and seventeen states filed amicus briefs in support of the postal worker. The Supreme Court agreed to hear the case on January 13, 2023. The parties argued in front of the Court on April 18, 2023. On June 29, 2023, the Court vacated the Third Circuit’s decision for USPS and remanded the case back to the district court. Writing for a unanimous Court, Justice Samuel A. Alito, Jr. clarified the rule for religious accommodations under Title VII: to deny a religious accommodation, an employer must show that granting that accommodation would cause “substantial increased costs in relation to the conduct of its particular business.” If the employee’s proposed accommodation would cause this hardship, the Court held that the employer must consider reasonable alternatives. 

A settlement conference took place before Magistrate Judge Craig M. Straw on October 12, 2023, but the parties did not reach a settlement agreement. 

USPS moved for summary judgment on January 16, 2024. On the same day, the postal worker moved for partial summary judgment on the failure to accommodate claim. On January 30, 2025, U.S. District Judge Jeffrey L. Schmehl denied both USPS’ motion for summary judgment and the postal worker’s motion for partial summary judgment. The court explained that the issue which resolved both motions was whether USPS produced sufficient evidence that it would face an undue burden, defined by the Supreme Court as “substantial increase in costs,” by allowing the postal worker a Sunday exemption. The court found that there was a genuine issue of material fact as to whether USPS would suffer an undue hardship because the court could not determine whether the costs set forth by USPS rise to the level of being substantial. 

A final pretrial conference was set for February 25, 2025. The case was ongoing as of February 13, 2025.
