This case is about a public-school corporation’s policy requiring teachers to call transgender students by their preferred name based on an official database. Brownsburg Community School Corporation (BCSC) established a policy allowing students to change their name in the official student database at the request of the student, their parents, and a health care provider. Once entered, teachers would then be required to call the student by their preferred name. The plaintiff, a Christian teacher at a BCSC school, requested an accommodation to refer to students by last name only to avoid contradicting his deeply held religious beliefs. BCSC initially granted the accommodation, but withdrew it the next year and requested the plaintiff resign, stating that the accommodation was detrimental to transgender students’ well-being and the learning environment for other students and faculty. The plaintiff resigned on April 30, 2018, but later attempted to rescind his resignation, which was rejected by the administration.

On June 18, 2019, the plaintiff filed suit against BCSC, as well as its superintendent, school board president, and other officials, in the U.S. District Court for the Southern District of Indiana. Represented by private counsel, the plaintiff alleged that BSCS had violated Title VII based on a failure to accommodate, retaliation, and the creation of a hostile work environment. He also sued under 42 USC § 1983, alleging several First Amendment violations, including content and viewpoint discrimination, retaliation, compelled speech, imposing conditions on speech, and infringement of the free exercise of religion, as well as violations of the Fourteenth Amendment's Due Process and Equal Protection Clauses. Finally, he brought several state law claims. The plaintiff sought a declaratory judgment, a preliminary and permanent injunction requiring reinstatement and back pay, compensatory and punitive damages, and attorneys' fees. Judge Jane Magnus-Stinson was assigned to the case.

On August 22, Indiana Youth Group (IYG), a non-profit providing for the safe and healthy development of LGBTQ youth in Indiana schools and communities, filed a motion to intervene as a defendant. IYG claimed that the plaintiff's case would require them to devote resources to affected transgender students at the high school as a result of the plaintiff's conduct should he win. In addition, the plaintiff’s request for a court order prohibiting Indiana school corporations from requiring teaches to address students by their requested name would undermine IYG’s mission.

On September 9, 2019, the defendants filed a motion to dismiss the case for failure to state a claim. On January 8, 2020, the court granted in part and denied in part the motion to dismiss. The court dismissed the claims under the First Amendment, holding that the speech at issue was not protected because it was part of the teacher's official duties, and that BCSC's policy did not infringe the plaintiff's right to free exercise because it was neutral and generally applicable. It also held that BCSC's policy was not void for vagueness under the Due Process Clause. However, the court allowed the plaintiff's Title VII claims based on failure to accommodate and retaliation to proceed. Finally, the court denied IYG’s motion to intervene as defendant. 432 F.Supp.3d 823.

Both parties subsequently moved for summary judgment. On July 12, 2021, the court granted summary judgment for BCSC. The court found that BCSC had not coerced the plaintiff's resignation, that the plaintiff had not shown his resignation was caused by the accommodation request, and that accommodating the plaintiff's religious beliefs would have caused BCSC undue hardship. 548 F.Supp.3d 814.

On August 10, 2021, the plaintiff appealed the summary judgment order to the Seventh Circuit Court of Appeals (Docket # 21-2475). On January 20, 2022, the oral arguments were heard before Circuit Court judges Ilana Diamond Rovner, Michael B. Brennan, and Amy J. St. Eve. While a decision was pending, the Supreme Court announced a judgment in Kennedy v. Bremerton School District (597 U.S. 507) on June 27, 2022, in which a high school football coach sued after losing his job for kneeling midfield in personal prayer after games.  The Supreme Court held that the employee had engaged in private speech, not government speech attributable to the school district, and the school district had burdened his rights to free exercise by suspending him. In response to that decision, the Circuit court in this case requested parties file supplemental briefs addressing how the Supreme Court’s ruling affected the appeal.

On April 7, 2023, the Circuit court affirmed the district court’s final judgment against the plaintiff, stating that BCSC had demonstrated as a matter of law that the accommodation had created an undue burden on their educational mission by harming transgender students and negatively impacting the learning environment. They also affirmed the district court’s denial of the plaintiff’s motion for summary judgment on retaliation, noting that the plaintiff had failed to produce evidence that the request for resignation was causally connected to his religious views. Judge Brennan wrote a concurrence in part and dissent in part, arguing that the plaintiff had established a prima facie case of religious discrimination. 64 F.4th 861.

The plaintiff requested a rehearing en banc, which the court delayed taking action on pending the Supreme Court’s resolution of the appeal in Groff v. DeJoy, in which a postal worker sued the USPS under Title VII (reasonable accommodations) after being fired for refusing to work on Sundays due to his religious beliefs.

On June 29, 2023, the Supreme Court announced their judgment in Groff v. DeJoy, holding that an employer must provide an accommodation unless it can show that the burden of granting an accommodation would result in substantial increased cost in relation to the conduct of its particular business. 600 U.S. 447. The Seventh Circuit ordered parties in this case to file supplemental briefs on the impact of the Groff judgment on this appeal, including whether or not the case should be remanded to the district court for reconsideration. Supplemental briefs were filled in July 2023, and on July 28, the Circuit court ordered that, in light of the Supreme Court judgments, its initial judgement (April 7) was vacated, and the case was remanded to the district court to apply the Supreme Court’s clarified standard. The case was remanded to district court and reassigned to Judge Kellie M. Barr. The parties moved for summary judgment in November and December 2023.

On April 30, 2024, the court granted summary judgment for BCSC under the clarified standard from Groff, finding that the accommodations would impose an undue burden on BCSC. 732 F.Supp.3d 943. Again, the plaintiff appealed to the Seventh Circuit. Oral arguments were heard on January 22, 2025, before Circuit Judges Ilana Diamond Rovner, Michael V. Brennan, and Amy J. St. Eve.

As of April 2025, there has been no further action in either district or circuit court. This case is ongoing
