This lawsuit is a challenge to the Federal Bureau of Investigation’s allegedly unconstitutional surveillance and arrest of the plaintiff. The plaintiff filed the lawsuit on May 10, 2017 in the U.S. District Court for the Eastern District of Pennsylvania. The plaintiff initially sued an FBI special agent and other unnamed federal agents and officials. The case was heard by Judge R. Barclay Surrick.

The plaintiff, a physics professor at Temple University, had been indicted and arrested in May 2015 for allegedly spying for the Chinese government by providing it with technological information from a US company. The government later dismissed the indictment. As part of the investigation, the FBI had allegedly surveilled the plaintiff’s communications based on Section 702 of the Foreign Intelligence Surveillance Act (FISA) and Executive Order 12333. Section 702 of the FISA Amendments Act of 2008, 50 U.S.C. § 1881a, permits the Attorney General and the Director of National Intelligence to conduct foreign intelligence surveillance targeting the communications of non-U.S. persons located abroad. The government need not establish probable cause that the target of electronic surveillance is a foreign power or agent of a foreign power, nor must the government specify the nature and location of the facilities or places that surveillance will occur. Though the plaintiff in this case was a U.S. citizen and resident, communications of U.S. citizens and residents are frequently collected “incidentally” if those U.S. persons are communicating with or about a targeted foreigner. 

Represented initially by private counsel and later by the American Civil Liberties Union, the plaintiff brought claims under Bivens and Ex Parte Young, alleging that the government’s surveillance under FISA had violated his Fourth Amendment right to be free from unlawful search and seizure and was based on false statements from FBI agents. He also alleged that the physical search of his house violated the Fourth Amendment, that the prosecution of him was malicious and violated the Fourth Amendment, and that the investigation and prosecution of him violated his Fifth Amendment Due Process and Equal Protection Rights because it was motivated by racial and ethnic discrimination, as the plaintiff was a former Chinese national in contact with Chinese entities. The plaintiff sought compensatory and punitive damages, an injunction requiring the government to return or destroy any information from his electronic devices or communications, and attorneys’ fees. 

On July 7, 2017, the plaintiff amended his complaint to add two family members as plaintiffs and to add the United States as a defendant. He also added several state tort claims under the Federal Tort Claims Act. Later that year, on September 25, the defendants moved to dismiss for lack of jurisdiction and for failure to state a claim.

The following month, on October 21, the plaintiff amended his complaint again, adding the Director of the FBI, the Attorney General of the United States, and the Director of the National Security Agency as defendants. The second amended complaint also added a constitutional claim for fabrication of evidence in violation of the Fourth and Fifth Amendment, and request for a declaratory judgment as to the government’s constitutional violations. However, the complaint removed the Bivens claim that the FISA surveillance had been unconstitutional, though it still contained general allegations about FISA surveillance.

Due to the amended complaint, the court denied defendants’ previous motions to dismiss as moot on November 1, 2017. The following year, on January 23, the US and the FBI moved to dismiss the case for lack of jurisdiction and failure to state a claim, and about a week later, the Attorney General, FBI Director, and NSA Director did the same.

On April 1, 2021, the court granted two of the motions to dismiss. First, the court dismissed the plaintiffs’ Bivens claims against the FBI agent, holding that this case is distinguishable from Bivens based on the type of search and the mechanism of injury and that Bivens should not be extended in this case. The court also held that the Bivens claim would be barred by qualified immunity as well because the defendants did not violate a clearly established right. Second, the court dismissed the plaintiffs’ tort claims because the defendants’ actions fell under an exception to the sovereign immunity waiver under the Federal Tort Claims Act, as they were actions in accordance with a discretionary duty. 2021 WL 1224164.

On September 17 of that year, at the request of the parties, the court certified a final judgment for the defendants so its decision could be appealed. The following week, the plaintiffs appealed the case to the Third Circuit Court of Appeals. The Third Circuit heard oral argument on September 14, 2022.

Over a year later, on May 24, 2023, the Third Circuit affirmed in part and reversed in part the district court’s ruling, remanding the case for further proceedings. The Third Circuit affirmed the district court’s dismissal of the plaintiffs’ Bivens claims. However, it found that the plaintiffs’ tort claims were incorrectly dismissed, as the plaintiffs had plausibly alleged a constitutional violation with their Fourth Amendment claim, and the discretionary exception to the Federal Tort Claims Act does not include unconstitutional acts. It also held that the Fifth Amendment claims were too conclusory and should still be dismissed. 68 F.4th 824.
