Do No Harm, a membership organization of healthcare professionals “who want to protect healthcare from radical, divisive, and discriminatory ideologies” filed the suit on behalf of two anonymous members, one white and one Asian American, who were barred from applying to Pfizer’s Breakthrough Fellowship Program as it was limited to Black, Latinx, and Native American applicants. Plaintiff’s complaint, filed September 15, 2022, in the U.S. District Court for the Southern District of New York, alleged that this selection criteria violated § 1981, Title VI of the Civil Rights Act of 1965, § 1557 of the Affordable Care Act (ACA), and New York state and city laws. Represented by private attorneys, Plaintiff sought declaratory and injunctive relief, attorneys’ fees, and nominal damages of $1. The case was assigned to District Judge Jennifer L. Rochon.

The same day as the complaint, Plaintiff motioned for a preliminary injunction to halt selection for the 2023 fellowship cohort. On December 16, 2022, Judge Rochon denied the motion. 646 F.Supp.3d 490. The court held that Plaintiff failed to establish associational standing for the purposes of § 1981 because it did not name any individual members who had suffered an injury in fact. She also found that Defendant did not meet the requirements for claims under Title VI and the ACA because, respectively, federal funds were not provided to Defendant for the primary purpose of providing employment and Defendant was not principally engaged in providing health care. Finding that Plaintiff did not have standing for any of the federal claims, the court  dismissed the case for lack of subject matter jurisdiction.

Plaintiff appealed to the Second Circuit, arguing that the lower court had incorrectly interpreted standing under § 1981 and that Judge Rochon  erred in dismissing the case sua sponte. The case was argued on October 3, 2023. On March 6, 2024, a panel comprised of Second Circuit Judges Dennis Jacobs, Richard C. Wesley, and Beth Robinson affirmed the District Court’s order. 96 F.4th 106. The opinion by Circuit Judge Robinson held that Judge Rochon properly found no Article III standing, specifically because Plaintiff had not given the real names of any members who had suffered an injury in fact. She also found that the case was properly dismissed for lack of subject matter jurisdiction.

On March 20, 2024, Plaintiff petitioned for a rehearing of the case, arguing that the panel’s decision on the real name issue was out of step with precedent and other circuits’ decisions about associational standing. The case was not reargued, but on January 10, 2025, the same panel of Circuit Judges vacated the previous opinion. 126 F.4th 109. The per curiam opinion (with Judge Wesley dissenting) did not address the real name issue; instead, it held that the District Judge applied the wrong evidential standard for standing when dismissing the case—because the suit was still at the pleadings phase, the standard for dismissal should have been lower than for the preliminary injunction itself. Therefore, Judge Rochon properly denied the preliminary injunction, but should have given Plaintiff an opportunity to remedy the insufficiency of the standing evidence rather than dismissing the case sua sponte.

Upon remand to the Southern District of New York, Plaintiff voluntarily dismissed the case on January 31, 2025. While the suit was ongoing, Defendant had changed the application criteria to allow white and Asian American applicants. Additionally, the fifth and final planned cohort of the fellowship had already been selected, so the issue was moot. 

This case is now closed.
