This is a case alleging systematic pay disparities between male and female employees and between Black and white employees. 

Seven Chicago Tribune journalists filed a class action lawsuit against the newspaper and its owner in the U.S. District Court for the Northern District of Illinois on May 16, 2024. Plaintiffs alleged systematic pay disparities between male and female employees and between Black and white employees. The plaintiffs filed their lawsuit against the Chicago Tribune, LLC, Alden Global Capital, and Tribune Publishing Company. The plaintiffs alleged that the defendants relied on diversity recruitment programs, which hire employees into temporary year-long positions that pay significantly less than non-diversity recruitment hirees, thus limiting the salary of women and minority journalists. Plaintiffs also alleged the defendants hired minority journalists from lower paying suburban newspapers in order to keep their starting salary lower; white male journalists were more often recruited from other major news organizations and were offered higher salaries to induce them to accept employment. Plaintiffs also alleged that defendants encouraged a culture of  “ pay secrecy,” which had a disparate negative impact on female and Black employees without a legitimate business need. Plaintiffs filed this lawsuit under the Federal Equal Pay Act, Equal Pay Act of 1963, Title VII of the Civil Rights Act of 1964, Illinois Human Rights Act, and Illinois Equal Pay Act. Plaintiffs sought declaratory relief that defendants have engaged in systemic Sex and racial discrimination against the Classes by paying female and/or African American employees less than their male or non-African American counterparts for substantially equal or substantially 

similar work; a permanent injunction against such continuing discriminatory pay practices, policies, and procedures; injunctive relief that effectuates a restructuring of Defendants’ compensation policies, practices, and procedures; the unpaid balance of wages owed, plus interest on that amount; liquidated damages; compensatory damages; attorneys’ fees, costs, and expenses; statutory and civil penalties; and other equitable remedies necessary. 

Plaintiffs sought to certify multiple classes. The plaintiffs sought to certify two “discrimination classes” under Title VII and IHRA: the sex-based class (for all non-managerial female employees) and the race-based class (for all non-managerial Black employees).  Plaintiffs also sought to certify several sex-based classes under the Illinois Equal Pay Act: Sex-based Reporter Class (all female reporters in Illinois), State Sex-Based Editor Class (all female editors in Illinois) and State Sex-Based Photojournalist Class (all female photojournalists in Illinois). They also sought to certify race-based classes under the Illinois Equal Pay Act: race-based Reporter Class (all Black reporters in Illinois), State Race-Based Editor Class (all Black editors in Illinois) and State Race-Based Photojournalist Class (all Black photojournalists in Illinois). Additionally, they requested to certify sex-based classes of reporters, editors, and photojournalists under the Fair Labor Standards Act (FLSA). The case was assigned to District Judge Thomas M. Durkin.

On August 12, 2024, defendant Alden Global filed a motion to dismiss the plaintiffs’ complaint. The motion argued that the Chicago Tribune is the plaintiffs’ employer, not defendant Alden, thus defendant Alden should not be held liable for any alleged discrimination. Further, defendant Alden argued that the plaintiffs did not fully exhaust their claims with administrative remedies before the Equal Employment Opportunity Commission or the Illinois Department of Human Rights. On the same day, the defendant Chicago Tribune, LLC filed a motion to dismiss the plaintiffs’ complaint. They also argued that the plaintiffs failed to exhaust their administrative remedies. The plaintiffs filed their response to the motion to dismiss on September 26, 2024.

As of January 2025, this case is ongoing.

By the same token, the Court denies Defendants' request to strike the brief. In addition to the language in Paragraph 7 of the Agreed Confidentiality Order entered today, the parties are advised that motions to seal will not be granted as to discovery documents filed with the Court unless the request complies with the common law of this Circuit. See Bond v. Utreras, 585 F.3d 1061, 1073 (7th Cir. 2009) (noting that public "has a presumptive right to access discovery materials that are filed with the court"); Baxter Int'l, Inc. v. Abbott Labs., 297 F.3d 544, 545-46 (7th Cir. 2002) (stating that filed discovery documents "that influence or underpin the judicial decision are open to public inspection unless they meet the definition of trade secrets or other categories of bona fide long-term confidentiality... In civil litigation only trade secrets, information covered by a recognized privilege (such as the attorney-client privilege), and information required by statute to be maintained in confidence (such as the name of a minor victim of sexual assault) is entitled to be kept secret"); Union Oil Co. of Cal. v. Leavell, 220 F.3d 562, 567-68 (7th Cir. 2000) ("Many a litigant would prefer that the subject matter of a case... be kept from the curious (including its business rivals and customers), but the tradition that litigation is open to the public is of very long standing."); Citizens First Nat'l Bank of Princeton v. Cincinnati Ins. Co., 178 F.3d 943, 945-46 (7th Cir. 1999) (warning courts not to allow parties "to seal whatever they want" and urging them to apply "a neutral balancing of the relevant interests" in connection with any good-cause determination presented by a motion to seal). Parties moving to seal are directed to review the foregoing case law, and any motion to seal will be taken by the Court as a certification that the movant has read the applicable case law and has ensured that it is making a good-faith argument that the document in question qualifies for sealing under the Seventh Circuit's stringent standards. Further, as to Paragraph 5(b)(7), this is a highly restrictive provision which prevents counsel even from showing designated material to a prospective witness during an interview or during deposition preparation, and the Court is open to a motion to lift or modify it as necessary, while under Paragraph 5(b)(9), the parties may reach their own agreement(s) to allow such use of designated material in this fashion.
