This is a case about religious freedom and anti-discrimination protections for LGBTQ+ people under Michigan state law. On August 29, 2022, Christian Healthcare Center (a faith-based, non-profit Christian healthcare provider) filed suit under 42 U.S.C. § 1983 against the Michigan Attorney General and several other state officials in the U.S. District Court for the Western District of Michigan. The case was assigned to Judge Jane M. Beckering. 

The plaintiff, represented by the Alliance Defending Freedom, alleged that Michigan's Attorney General had violated its First Amendment rights by interpreting the state's Elliot Larsen Civil Rights Act (ELCRA) and Equal Accommodations Act (EAA) to prohibit discrimination in employment and public accommodations based on gender identity and sexual orientation. This interpretation was in part based on the Michigan Supreme Court's decision in Rouch World LLC v. Mich. Dep't of C.R., which held that the "sex" discrimination barred by the ELCRA included discrimination based on sexual orientation.

The plaintiff argued that Michigan's interpretation violated its First Amendment rights to religious exercise, free speech, freedom of the press, and expressive association by 1) not allowing it to recruit for or hire people who share its religious values, 2) requiring it to provide treatments that violated its religious beliefs (including gender-affirming care), 3) not allowing it to make public statements in accordance with its religious beliefs, 4) compelling speech (including the use of pronouns that matched people's gender identity) in violation of its religious beliefs, and 5) imposing a vague and overbroad restriction on its speech. The plaintiff also challenged the ELCRA's prohibition on statements indicating a person is "unwelcome" at a place of public accommodation based on protected characteristics, arguing that this was vague in violation of the Fourteenth Amendment's Due Process Clause. The plaintiff requested a preliminary and permanent injunction to prevent enforcement of the relevant laws, a declaratory judgment, and attorneys' fees.

Michigan moved to dismiss the case on November 18, 2022, and the court granted the motion on March 29 of the following year. The court held that the plaintiff lacked standing to sue because it had not demonstrated any imminent injury. Specifically, the plaintiff had not shown that it would be imminently sued under the ELCRA or prosecuted under the EAA, and even if it were, Michigan courts had previously limited the ELCRA based on religious exemptions. 2023 WL 9058379.

In April 2023, the plaintiff filed a motion for reconsideration. Among other things, the plaintiff noted that the Michigan legislature had recently amended the ELCRA to explicitly ban discrimination based on gender identity and sexual orientation (i.e., codifying the Attorney General's interpretation of the statute). However, the court denied the motion on August 22, 2023, holding that this (and other case law developments) did not change its analysis. 2023 WL 9058396. On the same day, the plaintiffs appealed to the U.S. Court of Appeals for the Sixth Circuit (docket no. 23-1769).

On September 20, 2024, the Sixth Circuit issued an opinion that covered this case and two similar cases: St. Joseph Parish St. Johns v. Nessel and Sacred Heart of Jesus Parish, Grand Rapids v. Nessel. In this case, the Sixth Circuit affirmed in part and reversed in part the district court's judgment. The Sixth Circuit held that the plaintiff had sufficiently established standing because it was plausible that they could be sued based on the public accommodations and employment provisions of the ELCRA.

Following the Sixth Circuit's judgement, the plaintiff renewed its motion for a preliminary injunction in the district court on October 28, 2024. A few months later, on December 3, both parties submitted a stipulated order enjoining Michigan from initiating any charge or conducting any investigation or enforcement action against the plaintiff under the ELCRA based on alleged gender identity or sexual orientation discrimination. The agreement also required Michigan to hold any related complaints in abeyance during the case. That same day, the stipulated order was granted by the court.

As of April 19, 2025, this case is ongoing and in the discovery phase.
