This case challenges the Department of Education’s termination of $600 million in federal funding to teacher preparation programs in reliance on President Trump’s Executive Order 14151, “Ending Radical and Wasteful Government DEI Programs and Preferencing.” On March 3, 2025 The American Association of Colleges for Teacher Education, the National Center for Teacher Residencies, and the Maryland Association of Colleges for Teacher Education filed this lawsuit in the United States District Court for the District of Maryland Baltimore Division. Plaintiffs are teacher education programs across the United States. They named President Donald Trump, the U.S. Department of Education, and its Acting Secretary as Defendants. The case was assigned to Judge Julie Rebecca Rubin.

The complaint alleged that the Department of Education “summarily terminated many of Plaintiffs’ members’ TQP, SEED, and TSL grants.” In doing so, the Department unlawfully relied on the Executive Order, and failed to follow regulations in terminating the grants. While the official reason for these actions was that such grants were “inconsistent with, and no longer effectuate[], Department priorities,” the Department then published a press release titled “U.S. Department of Education Cuts $600 Million in Grants Used to Train Teachers and Education Agencies on Divisive Ideologies.” The complaint argues that the official justification was unlawful because the department did not follow regulations in terminating the grant. It also argued that the published reason is unlawful because it is based on portions of the Executive Order which this court already enjoined.

Represented by Private Counsel, plaintiffs sought declaratory and injunctive relief. They claimed that the executive order is unconstitutionally vague under Fifth Amendment Due Process. They also claimed that termination of the grants was arbitrary and capricious under the Administrative Procedure Act. The states of “California, Maryland, New Jersey, Colorado, Illinois, New York, Wisconsin, and the

Commonwealth of Massachusetts joined as plaintiffs to file suit in the United States District Court for the District of Massachusetts.” They alleged that former Acting Secretary Carter and Secretary McMahon “violated the APA by terminating TQP and SEED Grant Awards” and Judge Myong J. Joun entered a temporary restraining order. A hearing for a preliminary injunction was held on March 13, 2025. 

The court issued a memorandum opinion on March 17, 2025 granting in part and denying in part Plaintiff’s motion for a preliminary injunction. The court examined Plaintiff’s fifth amendment claim, finding that “the record before the court at this time fails to demonstrate that the Department likely terminated the Grant Awards at the directive of Executive Order 14151.” The court found, however, that the termination of the grant programs violated the APA. The court reasoned that “the Department’s action was unreasonable, not reasonably explained, based on factors Congress had not intended the Department to consider (i.e., not agency priorities), and otherwise not in accordance with law.” The court thus found that Plaintiffs were entitled to a preliminary injunction, under which Defendants must reinstate the grant awards consistent with their status immediately prior to the termination letters.

On March 18th, Defendants filed an emergency motion for reconsideration regarding the memorandum opinion and motion for the temporary restraining order. They claimed the court lacked subject matter jurisdiction. This case is ongoing.
