This case challenged Trump’s Executive Orders 14183 and 14168 preventing transgender individuals from serving in the military, as well as DoD and U.S. Air Force memoranda implementing the orders. On March 17, 2025, two active-duty Air Force service members filed a lawsuit in the United States District Court for the District of New Jersey. Judge Christine P. O’Hearn was appointed to the case. The plaintiffs sued Secretary of Defense, the Acting Secretary of the Air Force, and the United States Department of the Air Force. The plaintiffs sought injunctive and declaratory relief, claiming the EOs violated the Fifth Amendments and contract law. 

At issue in this case was Executive Order 14183, signed January 27, 2025, titled "U.S. Military Excellence and Readiness"; and Executive Order 14168, signed January 20, 2025, titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” Together, these EOs reinstated a ban on transgender military service that was initially passed by the first Trump Administration. The first transgender ban was overturned by the Biden Administration’s EO 14004, named the Austin Policy, which allowed transgender individuals to serve openly. EO 14183 and 14168 then overturned that Biden policy, mandating that service members could only serve according to their birth sex and prohibiting the use of pronouns inconsistent with that classification. Subsequent memorandums were issued by the Secretary of Defense, Assistant Secretary of the Air Force for Manpower and Reserve Affairs, and the Office of the Undersecretary of Defense for Personnel and Readiness, instructing implementation of the EOs. 

In their complaint, the plaintiffs alleged the EOs violated the Equal Protection Clause under the Fifth Amendment by banning transgender people from serving in the military on the basis of their sex and transgender status without lawful justification, requiring transgender people to serve only in accordance with their sex assigned at birth, and enforcing a discriminatory definition of the term “sex.” The plaintiffs also alleged the EOs violated their Procedural Due Process rights as guaranteed by the Fifth Amendment because they reasonably relied on the Austin Policy’s standards for military fitness, and the defendants failed to provide adequate procedural protections to prevent the deprivation of the plaintiffs’ career and future benefits earned in the course of their military service. Plaintiffs also assert an estoppel claim, arguing they reasonably relied on the Austin Policy regarding military fitness standards, and the EOs deprived them of property and liberty interests by eliminating the stability and certainty they previously had in their careers and benefits. 

On March 18, 2025, the plaintiffs filed a motion for a temporary restraining order (TRO) to prevent the defendants from (1) initiating administrative separation proceedings for the plaintiffs, and (2) implementing the voluntary separation offer outlined in the Implementing Guidance for EO 14183. They argued the new policy caused immediate and irreparable harm, stripping them of their careers and exposing them to forced separation under discriminatory conditions. Defendants filed a motion in opposition to the TRO request on March 20, arguing the plaintiffs were unlikely to succeed on their Equal Protection claim because (1) military judgment receives significant deference, (2) the policy did not classify based on sex, and if it did heightened scrutiny would not apply, (3) and the alleged animus was not a sufficient reason to grant the TRO. 

The Court granted the TRO on March 24, enjoining the defendants from "initiating administrative separation proceedings against Plaintiffs based on their transgender status" and "from enforcing or implementing any aspect of the Orders as to Plaintiffs" for fourteen days.

TEXT ORDER: The Court is in receipt of Defendants' Letter requesting a stay of the Temporary Restraining Order ("TRO"), (ECF No. 28), issued by the Court on March 24, 2025, (ECF No. 30), and Plaintiffs' Opposition thereto. (ECF No. 31). Defendants did not request a stay at the time the Court entered the TRO, and their current request fails to comply with Local Rule 7.1, which requires that all motions be accompanied with a brief or a letter stating no brief is necessary. As to the merits of the request, Defendants offer no explanation as to why a stay is warranted. Rather, Defendants merely assert, without citation to the relevant Rules of Civil Procedure or any supporting case law, that a stay is needed "so that they can proceed in an orderly fashion across the cases that challenge the same Executive Order and DoD policy." (ECF No. 30). Further, the record does not support a stay. Staying the TRO would return Plaintiffs to the unprotected status that prompted their Motion for a TRO, while leaving the TRO in place imposes no articulated burden on Defendants. Counsel's reliance on Department of Defense Policy, (ECF No. 26-1), which states that "no involuntary separation proceedings will begin before March 28, 2025," may change at any time and, given the Court's prior findings as to irreparable harm, the Court declines to accept counsel's uncertified assertion that no involuntary separations will occur before March 28, 2025.
