This case is one of several challenging Executive Order 14251, issued by President Trump on March 27, 2025. The order excluded numerous agencies and subdivisions—designated as having primary national security functions—from the collective bargaining protections afforded under the Federal Service Labor-Management Relations Statute and the Foreign Service Labor-Management Relations Statute (collectively, the FSLMRS). In connection with the EO, the Acting Director of the Office of Personnel Management (OPM) issued a memorandum to agency leadership providing implementation guidance, including specific determinations of which agencies and subdivisions were to be excluded from the FSLMRS, as found in Title VII of the Civil Service Reform Act. The cases are collected here

On March 31, 2025, the National Treasury Employees Union (NTEU), a labor union representing federal government employees, filed this lawsuit in the U.S. District Court for the District of Columbia. NTEU sued President Trump and several other federal officials in their official capacities, claiming violations of the First Amendment and for ultra vires actions. Represented by private counsel, the plaintiffs sought declaratory relief as well as injunctive relief to prohibit the defendants from implementing the Executive Order and the OPM Guidance. The case was assigned to District Judge Paul L. Friedman. 

On April 4, 2025, the plaintiffs moved for a preliminary injunction seeking to enjoin Section 2 of the Executive Order and the Office of Personnel Management’s guidance on the Order’s implementation. On April 25, 2025, Judge Friedman granted the plaintiffs’ motion for a preliminary injunction ordering that, aside from President Trump, all defendants were temporarily enjoined from implementing Section 2 of EO 14251 and the OPM guidance. 2025 WL 1201696. Specifically, the court found that the President’s interpretation of “primary function” and “national security work” was overly broad, citing Cole v. Young to warn that this approach could undermine the intended limits of the rule. It concluded that NTEU faced irreparable harm without an injunction, as the Executive Order threatened to drastically reduce the union’s bargaining power, impede employee advocacy, and cause severe financial losses—up to half its annual revenue in dues. 780 F.Supp.3d 237. 

On April 30, 2025, the defendants appealed the preliminary injunction order to the U.S. Court of Appeals for the D.C. Circuit and requested an administrative stay of the injunction pending appeals in both courts. The defendants argued they were likely to succeed because the district court lacked jurisdiction – claiming that the Federal Labor Relations Authority (FLRA) was the proper forum – and that the court wrongfully found the Executive Order ultra vires. They asserted the President’s authority to make national security exclusions was not subject to judicial review. Defendants also argued a stay was needed to avoid disrupting mission-critical work and to protect presidential authority, describing the injunction as an extraordinary intrusion. They claimed NTEU would not be harmed, as any injury was speculative or could be remedied through the FLRA.

On May 1, 2025, the district court denied the defendants’ motion for a stay. On May 6, 2025, the D.C. Circuit granted the defendants’ motion for a stay, concluding that NTEU had not demonstrated irreparable harm and that its claims of lost bargaining power, reputational injury, and financial losses were speculative or remediable. The court also held that the injunction itself caused irreparable harm to the President by limiting his national-security authority. 2025 WL 1441563. Circuit Judge Childs dissented, arguing that the government had not justified a stay, noting that its claims of harm were vague and undercut by its own directive to pause the Executive Order, and that maintaining the status quo could not cause irreparable injury. 

On May 23, 2025, the plaintiffs petitioned for rehearing en banc, arguing that the decision would "kill federal-sector unions," the very harm the district court sought to prevent with the injunction. The plaintiffs argued that the majority ignored the district court's findings that federal agencies were in the process of implementing the Executive Order when it found that the plaintiffs would not be irreparably harmed, and did not require the government to show that it would suffer irreparable harm by leaving the injunction in place, instead allowing it to simply "invoke the words 'national security.'" On July 16, the D.C. Circuit denied rehearing en banc. 

On June 9, 2025, the plaintiffs moved for summary judgment, arguing that the Executive Order should be permanently enjoined. On June 23, 2025, the defendants filed a cross-motion for summary judgment.

On July 29, 2025, the plaintiffs in a separate, related matter—American Federation of Labor and Congress of Industrial Organizations v. Trump, No. 1:25-cv-02445 (AFL-CIO) —submitted a notice of related cases, contending that their case was related to the current case, Federal Education Association v. Trump, No. 1:25-cv-01362 (FEA), and American Foreign Service Association v. Trump, No. 25-cv-1030-PLF (AFSA). On August 11, 2025, the court determined that the cases were related. 2025 WL 2301989.

On September 9, 2025, defendants filed their brief in the Court of Appeals. On October 1, 2025, the Court of Appeals ordered that appellants submit their briefs by October 10, 2025, and appellees submit their brief by November 5, 2025. The court also ordered oral arguments for this matter (25-05157), along with AFSA (25-5184) and FEA (25-5303), be scheduled on the same day, before the same panel in December 2025.

MINUTE ORDER: Upon consideration of the government's 37 Motion to Stay Pending Appeal, the motion is DENIED. Each of the government's arguments were addressed in this Court's Opinion of April 28, 2025, granting plaintiff's motion for a preliminary injunction. See Opinion [Dkt. No. 34]. Furthermore, as the Court explained in its Opinion, plaintiff has satisfied each of the preliminary injunction factors. This conclusion warrants preserving the status quo where plaintiff and federal employees subject to the Executive Order maintain the collective bargaining rights prescribed by Congress.
