This lawsuit, filed on April 7, 2025, in the U.S. District Court for the District of Columbia, challenges President Trump’s March 27, 2025, Executive Order titled “Exclusions from Federal Labor-Management Programs” that terminated the collective bargaining rights of certain Foreign Service members at the Department of State and USAID, overriding the Foreign Service Labor-Management Relations Statute (FSLMRS). 

FSLMRS is a law that applies labor and union protections for certain foreign government agencies (such as the Department of State, the Agency for International Development, the Department of Agriculture, and the Department of Commerce). Despite extending collective bargaining rights broadly to employees of the foreign service, Congress granted the President the authority to “exclude any subdivision of the Department from coverage” of the Statute under §4103(b), though this exclusion had never before been invoked. Section 3 of the Executive Order excludes employees of “agency subdivisions” of the Department of State and USAID from the protections of the FSLMRS.

The American Foreign Service Association (AFSA), a federal labor union that represents approximately 18,000 Foreign Service members, argues that the Executive Order violates FSLMRS by unlawfully stripping their collective bargaining rights without a valid national security justification. AFSA claims the actions were retaliatory, targeting the union for opposing the administration’s policies. This case was assigned to Judge Paul L. Friedman.

The defendants in the case include President Trump, the Department of State and its Secretary, USAID, and the Office of Personnel Management and its Secretary. AFSA brought three counts:  (1) Section 3 of the Executive Order is ultra vires because it essentially repeals FSLMRS, thereby violating separation of powers principles; (2) Section 3 of the Executive Order is ultra vires because it was not based on the criteria in Section 4103(b); and (3) Section 3 of the Executive Order reflects retaliation against AFSA in violation of its First Amendment rights.

AFSA seeks declaratory and injunctive relief enjoining defendants from enforcing the Executive Order or any accompanying guidance.

On April 15, the plaintiff filed a motion for a preliminary injunction seeking the court to enjoin the defendants from enforcing the Executive Order. In a case concerning this same Executive Order, National Treasury Employees Union v. Trump, Judge Friedman had issued a preliminary injunction, enjoining its operation. Judge Friedman found that the same analysis applied here. First, the court determined that it had jurisdiction, since, contrary to the defendants' claim, there is no special statutory review scheme precluding district court review. "The Executive Order excludes the agency subdivisions from coverage of the Statute, and thus the [FSLMRS's] administrative review scheme cannot be used to challenge that exclusion." 

Turning to the merits, the court determined that the plaintiffs were likely to prevail on the merits of their claim, since the President's "Executive Order was likely ultra vires because he appeared to either disregard or apply an overly broad interpretation" of the terms "primary function" and "national security" within the statute. The court found that the loss of bargaining power and the risk of significant loss of revenue to AFSA if the Executive Order was enforced represented "irreparable harm" warranting a preliminary injunction. Therefore, the court issued a preliminary injunction on May 14, finding Section 3 of the Executive Order unlawful and enjoining all the defendants, except for President Trump, from implementing the order. The court also ordered the parties to file a joint status report proposing a schedule for the case by May 20. 2025 WL 1387331. 

On May 21, 2025, the defendants appealed the preliminary injunction to the DC Circuit. The next day, the defendants asked for an immediate administrative stay and for a stay pending appeal. As of June 16, the stay motion had been fully briefed for two weeks without the court of appeals taking action. 

Back in the district court, the defendants filed a motion for a stay pending appeal on May 22. Since Judge Friedman was unavailable, the motion was referred to Judge Randolph D. Moss. On May 30, Judge Moss deferred ruling on the motion. First, despite the defendants' claims that they were suffering irreparable injury, the judge noted that they waited a week before requesting a stay, which seemed to belie their claims. Furthermore, given Judge Friedman's absence and the fact that the court of appeals seemed poised to rule on the motion on an expedited basis, the court found deferral appropriate. However, the court made clear that if Judge Friedman returned before the court of appeals ruled on the defendants' motion, he could take any steps he deemed appropriate. On June 17, Judge Friedman also denied the defendants' motion, finding that they made the same arguments on the merits that the court had found unpersuasive before. The court also found that, while the injunction might cause the defendants some harm, it was not substantial, since the "Court’s preliminary injunction order merely maintains the status 
quo by preserving the collective bargaining rights for a significant number of federal employees, 
as prescribed by Congress nearly fifty years ago." Finally, the court repeated its finding that the plaintiffs would suffer irreparable harm absent an injunction. 

This case is ongoing.

MINUTE ORDER: In light of the circumstances surrounding Defendants' motion to stay pending appeal, Dkt. 42, the Court will defer ruling on Defendants' motion. Under Federal Rule of Appellate Procedure 8(a), a party must "ordinarily" move first in the district court for a stay pending appeal before moving in the Court of Appeals for such relief. A party is relieved of this obligation if moving first in the district court would be "impracticable." Fed. R. App. P. 8(a)(2). The purpose of this rule (and its exceptions) is to conserve the courts' and the parties' resources, while ensuring that a party subject to an adverse judgment may timely seek relief to avoid an irreparable injury. Here, the Court concludes that deferral is appropriate for several reasons. First, although Defendants aver that they are suffering an irreparable injury from Judge Friedman's preliminary injunction order, Dkt. 37, that contention is at least somewhat belied by their weeklong delay in moving for a stay. Second, Judge Friedman is currently unavailable, but he will become available again in the coming weeks, and so there is no compelling need for this Court to intervene and reconsider his decision in the interim. Finally, and most importantly, Defendants moved for a stay in the Court of Appeals, and that court ordered the parties to brief Defendants' motion on an expedited basis. Because the Court of Appeals appears poised to decide Defendants' motion, and because the Court of Appeals is the more appropriate forum for arguing Defendants are likely to prevail in the efforts to overturn the decision of another judge who sits on this same Court, the Court concludes that deferral is the most appropriate course. In the unlikely event that the D.C. Circuit does not decide whether to grant a stay before Judge Friedman returns to the office, he will be far better situated than the undersigned to evaluate the merits of Defendants' motion to stay his order.
