This lawsuit challenged the constitutionality of a Florida statute that prohibits public school teachers from sharing their personal pronouns or titles with students if those identifiers do not match the sex assigned to them at birth. 

On December 13, 2023, three Florida public school teachers filed suit against the Florida Department of Education, the State Board of Education, multiple Florida state officials in their official capacities, and the teachers’ respective employers: Hillsborough County School Board, Lee County School Board, and Florida Virtual School. All three plaintiffs were transgender or nonbinary educators who alleged they were harmed by the state’s enforcement of the statute, Florida Statutes § 1000.071(3). Represented by the Southern Poverty Law Center, Southern Legal Counsel, and private counsel, they filed their lawsuit in the U.S. District Court for the Northern District of Florida, where it was assigned to District Judge Mark E. Walker.

Seeking compensatory damages, injunctive relief, and declaratory relief, the plaintiffs brought claims under several statutes:

  • Title VII of the Civil Rights Act (employment discrimination on the basis of sex);
  • Title IX of the Education Amendments of 1972 (sex discrimination in educational programs);
  • 42 USC § 1983, based on the First Amendment (by prohibiting educators from expressing their gender identity through speech); and
  • 42 USC § 1983, based on the Fourteenth Amendment's Equal Protection Clause (by discriminating based on sex).

The Florida statute, enacted as part of House Bill 1069 (2023), requires all K–12 public school institutions to treat sex as an immutable biological trait and prohibits school employees from identifying themselves to students using pronouns or titles that do not match their sex assigned at birth. Violations may lead to discipline, including revocation of a teaching certificate.

Each plaintiff alleged injury. One plaintiff, a transgender woman, alleged that her school instructed her to erase her pronouns and title from her whiteboard and to refrain from correcting students who misgendered her. The second plaintiff, who is nonbinary, was fired by Florida Virtual School after refusing to remove “Mx.” from their professional title and has since been placed under investigation by the Department of Education. The third plaintiff, a transgender woman, alleged that Lee County officials instructed her not to use female pronouns or titles at work, even in private communications.

On April 9, 2024, the court granted one plaintiff's motions for a preliminary injunction (in part), holding that the Florida’s law likely violates the First Amendment. The court enjoined Florid from enforcing § 1000.071(3) - but only against the one plaintiff (who filed the motion). 729 F.Supp.3d 1255. The defendants appealed this order to the US Court of Appeals for the Eleventh Circuit.

However, the Florida defendants filed motions to dismiss all of plaintiffs’ claims and, on April 19, 2024, the court dismissed the plaintiffs’ Title IX and Title VII claims, reasoning that the plaintiffs hadn’t established a causal connection between discriminatory animus and adverse employment action. However, the court denied the motion as to the Equal Protection Clause claim and the First Amendment claim. 730 F.Supp.3d 1232.

The plaintiffs filed an amended complaint on April 29, 2024, re-alleging their Title IX and Title VII claims with greater detail. The Florida defendants again moved to dismiss. This time, the plaintiffs prevailed on all counts: On July 10, 2024, the court denied the defendants’ motions, holding that plaintiffs had plausibly alleged that Florida’s pronoun ban altered the “terms, conditions, or privileges” of their employment. The court found that the statute forced plaintiffs to suppress aspects of their identity essential to professional communication and undermined their credibility and classroom authority. These, the court held, were cognizable harms under both Title VII and Title IX. 739 F.Supp.3d 1023.

Litigation resumed in the district court. Meanwhile, in the Eleventh Circuit, oral arguments were held on September 24, 2024.

As of May 8, 2024, the case remains ongoing.
