Case: In re Withrow

This dispute challenges the Trump Administration's transgender policies as violating federal civil rights law and equal protection. On May 5, 2025, an individual complainant filed an administrative complaint with the Illinois National Guard, the Department of Defense, and the Office of Personnel Management, alleging that various policies ordered pursuant to Executive Order 14,168, "Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government," restricting her use of bathrooms and other accommodations, were unlawful. The complainant is seeking to represent all transgender and/or intersex federal employees prohibited from using bathrooms and exercise facilities based on gender.
