This case challenged the alleged refusal of Sheetz, a regional convenience store chain, to hire persons based on their criminal records, thereby disparately impacting Black, Native American, and multiracial applicants. The Equal Employment Opportunity Commission (EEOC) found that 14.5% of Black applicants did not pass Sheetz’ screening and were thus rejected by Sheetz. This rate was 13% for Native applicants and 13.5% for multiracial applicants—but less than 8% for white applicants. The EEOC alleged that the disparate impact of Sheetz’ hiring practices constituted a violation of Title VII of the Civil Rights Act of 1964.

The EEOC, as plaintiff, filed this case on April 17, 2024, in the U.S. District Court for the District of Maryland. The lawsuit named Sheetz, Inc. and two of its subsidiary companies, Sheetz Distribution Services, LLC and CLI Transport, LP, as defendants. The EEOC sought a permanent injunction preventing defendants from racial discrimination in hiring, including usage of their existing hiring processes; an order requiring defendants to implement policies remedying their past discriminatory practices; and retroactive relief to a putative class of injured applicants. The case was initially assigned to Judge Julie Rebecca Rubin.

On October 4, 2024, following defendants’ motion, the case was transferred to the U.S. District Court for the Western District of Pennsylvania and reassigned to Judge Stephanie Lou Haynes of that court. All three defendants were based in Pennsylvania at the time of the litigation.

The Pennsylvania court denied defendants’ partial motion to dismiss on March 14, 2025, finding that the EEOC’s claims from 2015 and 2016 were not time-barred under Title VII and were validly brought by the Commission.

On June 6, 2025, following the transition from the Biden Administration to the Trump Administration—and the resulting and disputed change in the EEOC’s leadership—the EEOC moved to dismiss its complaint. The EEOC requested that the court defer any dismissal for at least 60 days to allow individual parties to retain private counsel and intervene to protect their rights. A decision on that motion is pending. This case is ongoing.
