This case challenges the Trump administration's mass termination of federal diversity, equity, and inclusion personnel through executive orders that plaintiffs alleged constituted unlawful retaliation and discrimination.

Four former federal employees filed a putative class action lawsuit on December 3, 2025, in the United States District Court for the District of Columbia against President Donald J. Trump and numerous federal agencies, challenging their terminations under anti-diversity, equity, and inclusion executive orders. Plaintiffs alleged they were terminated pursuant to Executive Orders 14151 and 14173 and related implementing directives. According to the complaint, President Trump characterized diversity, equity, and inclusion initiatives as "Marxist" during his campaign and pledged to eliminate all DEI programs and personnel from the federal government. Plaintiffs alleged that immediately upon taking office, Trump signed the anti-DEI executive orders directing the elimination of all DEIA-related offices, programs, and positions within 60 days, with the Office of Personnel Management subsequently issuing directives requiring agencies to place DEI employees on administrative leave and execute reductions-in-force.

The plaintiffs contended this constituted not merely a policy change but a targeted campaign to punish perceived political enemies and eliminate women, people of color, and those perceived as advocating for protected racial or gender groups. They brought seven causes of action including: First Amendment retaliation; intentional discrimination under Title VII of the Civil Rights Act of 1964; 42 U.S.C. § 2000e et seq. based on gender and race/ethnicity; disparate impact discrimination; and violations of the Civil Service Reform Act (CSRA), 5 U.S.C. § 7511 et seq., by, inter alia, removing federal workers through the imposition of government-wide Reductions in Force (“RIFs”) that were, as ordered and implemented, not lawful. Plaintiffs sought class certification, declaratory relief, reinstatement, back pay, compensatory damages, attorneys' fees, and other equitable relief.

The case was assigned to District Judge Tanya S. Chutkan.

On January 12, 2026, plaintiffs filed an amended complaint that substantially expanded the lawsuit by adding four new named plaintiffs who brought additional factual allegations detailing their specific experiences with the challenged policies. The amended complaint also refined the claims structure by specifying which plaintiffs would pursue each cause of action rather than having all claims brought by all plaintiffs collectively. Additionally, the complaint incorporated new factual allegations, including a quote from Stephen Miller, United States Homeland Security Advisor, about "communist, woke, DEI strangulation" and detailed examples of incorrect RIF notices that affected the new plaintiffs.

On February 1, 2026, defendants filed a consent motion seeking to extend their answering deadline. As of February 17, 2026, defendants have yet to file a response.
