On June 29, 2026, the National Treasury Employees Union (NTEU) filed suit against the Internal Revenue Service, the Department of the Treasury, and the Department of Health and Human Services in the U.S. District Court for the District of Columbia, asserting claims under the Administrative Procedure Act and seeking mandamus relief related to violations of the Rehabilitation Act of 1973. NTEU alleged that after the Trump Administration's 2025 directive ending remote work, the agencies revised their accommodation procedures but failed to process thousands of telework-based requests, leaving backlogs of over 5,800 at the IRS and 9,000 at HHS. Named employees alleged months- or years-long delays without routing, interim accommodations, or decisions. NTEU sought declarations that the delays were unlawful, a writ of mandamus compelling specific processing steps and compliance reporting, and attorneys' fees and costs.
