The Oklahoma City office of the EEOC brought this action in the U.S. District Court for the Western District of Oklahoma, against Health Food Associates, Inc. The complaint, filed in September 2005, alleged disability discrimination in violation of the Americans with Disabilities Act of 1990; specifically that Defendant refused to hire the charging party because she was disabled and failed to reasonably accommodate her. Both Defendant and the EEOC moved for summary judgment in August 2006 and in October 2006 the EEOC's motion was denied and Defendant's motion was granted. The EEOC appealed in December 2006 but in February 2007 the parties dismissed the appeal by stipulation.
