The Baltimore District Office of the EEOC brought this suit against Von Hoffmann Graphics, Inc., which is a commercial printing company, in July of 2001, in the U.S. District Court for the District of Maryland. The suit was based on an alleged violation of the American's With Disabilities Act, when a deaf employee contacted the EEOC about possible discrimination. The suit commenced and no major events took place for about a year. Then within a month of each other, both parties filed for summary judgment. The plaintiff's motion was denied and the defendant's motion was partially granted because, as the court reasoned, the employee was never constructively discharged. Finally the parties were ordered to a settlement conference and the result was a settlement.
A consent decree was signed in April of 2003. According to the terms of the consent decree, the complainant was to receive $54,000 and the defendant was enjoined from discriminating and retaliating and had to post notice of the suit in their Frederick, Maryland facility.
