Case Summary

In September 1997, the EEOC district office in New York brought this action against the Guardian Life Insurance Company and the Staten Island Savings Bank in the U.S. district Court for the Eastern District of New York. Although the complaint is not available, the memorandum opinion from the Court of Appeals states that one of the defendant's employees alleged that the both defendants violated Title I of the Americans with Disabilities Act of 1990 (ADA) by providing different benefits for those employees who suffered from mental or emotional disabilities from those who suffered from physical disabilities. The defendants quickly moved for dismissal for failure to state a claim. The claim was dismissed in November 1998 and the EEOC appealed, but the decision was affirmed. See E.E.O.C. v. Staten Island Savings Bank, 207 F.3d 144 (2nd Cir. 2000).
