Case Summary

The EEOC's Charlotte district office sued Sara Lee Corporation on February 26, 1999 in the U.S. District Court for the District of South Carolina. The EEOC alleged that the defendant violated the Americans with Disabilities Act when it discriminated based on physical disability (complex partial seizure) by failing to accommodate an employee's disability and not change her shift after deciding to change the shifts. Defendant filed a motion for summary judgment on December 10, 1999, which was granted on February 24, 2000. The EEOC filed an appeal on April 20, 2000, but the appellate court affirmed the district court's decision.
