The Seattle District Office of the EEOC brought this ADA suit against Boeing Company in July 1999, in the U.S. District Court for the Western District of Washington. The complaint alleged that the defendant discriminated against the charging parties because of disability by withdrawing offers of employment because of disability. The defendant moved to dismiss, but the motion was unresolved because the parties reached a settlement December 2001.

The two year Settlement Agreement called for the defendant to make improvements in its pre-employment medical screening process, conduct training and awareness programs on the ADA, provide the EEOC with periodic reports on compliance, and pay the charging parties and claimants a total of $89,000 in backpay and nonmonetary damages.
