The Houston District Office of the EEOC brought this action in the U.S. District Court for the Southern District of Texas, against U.S. Ship Management. The complaint, which was filed in September 2003, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964. In September 2005 the parties entered a consent decree and it was signed by the judge one month later. The complaint was not available in this case.

The decree, which was valid for either three years, or until the Defendant ceased to operate as a legal entity in the State of Delaware, provided for the Defendant to pay a total of $31,000 to the three charging parties. The amount given to each charging party was not included in the decree. The decree additionally included non-discrimination and non-retaliation provisions, and prohibited the Defendant from implementing any rules which required employees to speak English only while during work hours, unless the rule was needed for a legitimate business need and constituted a bona fide occupational qualification. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
