On January 15, 1993, one African-American employee of defendant filed a lawsuit on her own behalf under Title VII of the 1964 Civil Rights Act, 42 U.S.C.A. §2000e et seq. against defendant Norfolk Southern Corporation in the U.S. District Court for the Northern District of Alabama. Subsequently the complaint was amended to include allegations of classwide discrimination, and other named plaintiffs intervened to join the suit. Plaintiffs, represented by private counsel, asked the court for injunctive and monetary relief, claiming that defendant has discriminated against plaintiffs on the basis of their race in violation of Title VII. One plaintiff, Carol Moore, individually claimed that defendant discharged her in retaliation for the charges of discrimination she filed against it with EEOC.

On December 22, 2000, the parties entered a Consent Decree, wherein defendant agreed to implement extensive non-discriminatory employment practices and pay $28,000,000 to a settlement fund. On March 2, 2001, the Court (Judge U.W. Clemon) approved the Consent Decree and dismissed the case.
