This is a case about alleged employment discrimination by the California prison system. The plaintiffs, a group of corrections officers, filed a putative class action lawsuit on March 25, 2019, in the Superior Court of Los Angeles County, against the California Department of Corrections & Rehabilitation (CDCR). Represented by private counsel, the plaintiffs alleged that the defendants discriminated against pregnant corrections officers, in violation of California's Pregnancy Disability Leave Law (PDLL), which requires employers to provide sufficient pregnancy leave. The case was heard by Judge Elihu M. Berle.

The plaintiffs alleged that after they requested reasonable accommodations due to their pregnancies, the CDCR provided them with three options: 1) keep their positions, confirm they could do all the tasks that were part of their job (including running and subduing inmates), and waive any medical restrictions or employer liability for injury; 2) take a demotion and get less pay; 3) take accrued paid or unpaid leave. The plaintiffs argued that these options would all violate the PDLL, and that forcing pregnant corrections officers to meet strenuous physical requirements effectively disqualified pregnant people from the corrections officer job. Further, they argued that these physical requirements were not necessary because they could instead be assigned to light duty assignments. The plaintiffs also alleged that the CDCR retaliated against them for complaining about pregnancy discrimination and asking for accommodations for their pregnancies. The plaintiffs sought a declaratory judgment, preliminary and permanent injunctive relief, compensatory or nominal damages, and attorneys' fees.

Two cases raising similar claims were subsequently filed with the same court: Bagube v. CDCR (docket no. 20STCV10154), filed on March 13, 2020, and Department of Fair Employment and Housing v. CDCR (docket no. 20STCV46485), filed on December 4, 2020. The three cases were marked as related and Carreon was designated as the lead case.

On September 27, 2019, the court granted the plaintiffs' motion for a preliminary injunction. It subsequently ordered the defendants to provide reasonable accommodations to the plaintiffs and let them be assigned to light duty if they were pregnant. The order only applied to the named plaintiffs, not the putative class.

The plaintiffs moved for class certification on February 4, 2020. On August 3, 2020, the court certified a class of CDCR employees and two subclasses: 1) all current and former CDCR employees with "peace-officer status" who sought, but were denied, accommodation for a pregnancy-related disability between March 24, 2018 and March 25, 2019; 2) all current and former CDCR employees with "peace-officer status" who were deterred from seeking accommodation for a pregnancy-related disability between March 24, 2018 and March 25, 2019.

The plaintiffs filed an amended complaint the following year, on January 7, which extended the class definition's date range through May 31, 2020. In March 2020, the CDCR implemented a new policy under which employees (including pregnant employees) with temporary medical restrictions could get a waiver to not perform certain tasks. 

The plaintiffs moved for summary judgment on June 22, 2021, but the court denied the motion on February 25, 2022. On September 15, 2022, the defendants moved to decertify the class, but the court denied the motion on December 1 of that year. Discovery continued for the next year and a half. The plaintiffs and defendants both moved for summary judgment in October 2023. 

Before the court ruled on the motions for summary judgment, the parties filed a motion for preliminary approval of a settlement on March 26, 2024, which covered all three of the related cases. The proposed settlement class covered anyone who was pregnant while working for CDCR between June 15, 2015, and May 31, 2020. CDCR agreed to pay a total of $5.1 million, which included up to $1,683,000 in attorneys' fees, $20,000 in service awards to class representatives, and $3.2 million in damages to the class. CDCR also agreed to continue complying with state anti-discrimination law and to keep training its employees on compliance.

As of December 23, 2024, the court has not ruled on the motion for preliminary approval of the settlement.
