This lawsuit challenged the Pregnant Workers Fairness Act's requirement that employers provide reasonable accommodations for employees experiencing limitations relating to abortion.

On July 24, 2024, the Catholic Benefits Association and the Bismarck Diocese (collectively, “CBA”) sued the United States Equal Employment Opportunity Commission and the Chair of the United States Equal Employment Opportunity Commission (collectively, “EEOC”) in the United States District Court for the District of North Dakota. According to CBA, the Pregnant Workers Fairness Act (“PWFA”) and Title VII of the Civil Rights Act of 1964 (“Civil Rights Act”), required CBA members, contrary to their Catholic faith, “to accommodate their employees’ abortions and immoral fertility treatments, to use false pronouns when requested by transitioning employees, to abstain from expressing Catholic teaching regarding sexual issues, and to give employees of one sex access to private spaces reserved to those of the other sex.” 

CBA alleged that the PWFA violated the Administrative Procedure Act by (a) not being in accordance with the law, (b) being in excess of statutory authority and limitations, and (c) being arbitrary, capricious, and an abuse of discretion; violated the First Amendment right to (a) free speech, (b) free exercise of religion, and (c) church autonomy; violated Religious Freedom Restoration Act; and that religious entities were exempt from PWFA with respect to the employment of individuals of a particular religion. CBA sought declaratory and injunctive relief. CBA was represented by private counsel. This case was assigned to District Judge Daniel M. Traynor and Magistrate Judge Clare R. Hochhalter.

On July 30, 2024, CBA filed a motion for preliminary injunction to prevent the EEOC from implementing the PWFA and the Civil Rights Act without limitation against CBA and extend injunctive relief to all present and future members of CBA and anyone working with CBA. 

On September 23, 2024, the court granted the motion for preliminary injunction. The court found that CBA had concrete and imminent harm that conduct based on sincerely held religious beliefs would violate both the PWFA and the Civil Rights Act, and that CBA had the associated standing required to bring this suit. Thus, the injunction prohibited EEOC from enforcing the PWFA and the Civil Rights Act against any present and future members of CBA or against anyone working with CBA. EEOC and its agents were also prohibited from initiating any investigation into claims that a covered employee violated PWFA or the Civil Rights Act and from issuing any notice of a right-to-sue under prohibited terms. 

On November 12, 2024, CBA filed a motion for summary judgment as well as a motion for a permanent injunction. 

On December 6, the EEOC filed a cross-motion for summary judgment. The EEOC argued that CBA lacked standing because they failed to demonstrate they faced any current or imminent injury. Second, CBA was not entitled to relief under the Religious Freedom Restoration Act or any other statutory or constitutional provisions because the EEOC had expressly recognized that religious defenses and exceptions applied to the PWFA and the Civil Rights Act, and CBA did not prove that this approach was unlawful or that they were entitled to a categorical, blanket exception. And lastly, CBA did not identify any speech that they wished to engage in, or demonstrate that such speech was proscribed by the portions of the PWFA or Civil Rights Act they challenged.

In April 2025, the court granted CBA’s permanent injunction, granted in part and denied in part their motion for summary judgment, and denied the EEOC’s motion for summary judgment. In this order, the court noted that presidential administrations have changed since the case was originally filed and political changes may impact the case. The court granted CBA’s motion to turn the preliminary injunction into a permanent injunction because the facts of the case have not changed and non-compliance would have substantial adverse consequences on CBA’s free expression of their religious beliefs. The EEOC was permanently enjoined from interpreting or enforcing the Civil Rights Act on the CBA or any of their members (per the court’s Final Rule and Enforcement Guideline). This means that certain Catholic employers no longer need to follow EEOC guidelines protecting workers who seek abortions or fertility treatments. On the claim that the PWFA violated CBA’s rights under the Religious Freedom Restoration Act, summary judgement was granted. The rest of CBA’s claims for summary judgement were denied without prejudice. The court also denied the EOOC’s motion for summary judgment. 

This case is ongoing as of October 2025.
