On January 16, 2025, the EEOC brought this action, under Title I of the Americans with Disabilities Act and Title VII of the Civil Rights Act, against FedEx for unlawful employment practices on the basis of disability in the United States District Court for the Southern District of New York. Particularly, the EEOC alleged that FedEx violated the Americans with Disabilities Act and the Civil Rights Act when it failed to reasonably accommodate the Charging Party and other similarly aggrieved disabled dispatchers who requested telework as a reasonable accommodation for their disabilities in New Jersey and New York. The EEOC sought a permanent injunction to stop the Defendant from engaging in disability discrimination, an injunction-like settlement to order FedEx to change policies, practices, and programs, and attorneys fees and damages to the Charging Party and other similarly situated dispatch employees. The case is overseen by U.S. District Court Judge Mary Kay Vyskocil.

As of March 19, 2025, the court has directed the parties to engage in mediation.

ORDER TO SHOW CAUSE: Accordingly, IT IS HEREBY ORDERED that by July 30, 2025 (1) the parties shall file the required Joint Letter, including all of the information enumerated in the Court's April Order, and (2) each party shall file a letter showing cause why it should not be sanctioned.
