Background: H-1B Visas and United States of America v. Facebook

An H-1B visa is a temporary authorization that allows a foreign national to enter and work in the United States. H-1B visas are generally issued for specialty occupations (like information technology, engineering, finance, and medicine). H-1B visas are initially issued for up to three years, but H-1B workers can usually extend their visas up to a total of six years. H-1B workers must be sponsored by their U.S. employers. And by law, employers must pay H-1B workers at least as much as other workers with similar experience.

After six years, employers may sponsor H-1B workers for permanent residency in the United States if the employer certifies to the Department of Labor that there are no qualified U.S. workers for the role.

In 2019, the U.S. Department of Justice (DOJ), Civil Rights Division, initiated an investigation into whether Meta’s (then known as Facebook, Inc.) hiring practices discriminated against U.S. citizens and nationals, in favor of H-1B workers. DOJ found that Meta intentionally “deter[red] U.S. workers from applying for” certain permanent positions it “earmark[ed] for” H1-B employees who requested permanent residency status. In December 2020, DOJ initiated an administrative proceeding against Meta, alleging that Meta’s hiring practices violated the Immigration and Nationality Act’s anti-discrimination provision. United States of America v. Facebook, Inc., OCAHO 2021B00007. DOJ and Meta settled the case in October 2021: Meta did not admit liability, but paid a civil penalty of $4.75 million, paid $9.5 million into a settlement fund for harmed U.S. workers, and agreed to change its job recruitment process.

Rajaram v. Meta Platforms, Inc.

Despite settling with DOJ, Meta was still subject to potential private lawsuits by U.S. citizens and nationals regarding its alleged discriminatory hiring practices. On May 17, 2022, a plaintiff filed such a suit in the U.S. District Court for the Northern District of California. Represented by private counsel, he alleged that Meta had violated 42 U.S.C. § 1981 (prohibiting discrimination in contracting) by giving preference to H-1B workers over American nationals when hiring for certain positions.

The plaintiff alleged that he had twice applied for positions at Meta, that his Meta interviewers had (on at least one occasion) said he was the “right guy” for the job and “perfect” for the role, but that Meta did not hire him on either occasion because he was a U.S. citizen. Repeatedly referencing the DOJ’s findings, the plaintiff's complaint theorized that Meta preferred hiring H-1B workers because Meta illegally paid those workers less than their market rate; since H-1B workers relied on their employment status to maintain legal residency, Meta had leverage to pay those workers less than American nationals with the same skills. The plaintiff filed suit on behalf of himself and a putative class of all individuals who were not visa holders and who applied for specified positions with Facebook and/or Meta in the U.S. but were not hired. The plaintiff sought a permanent injunction barring Meta from engaging in its alleged discriminatory hiring practices, as well as attorneys’ fees, compensatory damages, and punitive damages—on behalf of himself and the class.

Meta then filed a motion to dismiss the lawsuit, arguing that even if the plaintiff' allegations were true, Meta did not violate any law because U.S. citizens are not a protected class under 42 U.S.C. § 1981. Magistrate Judge Laurel Beeler agreed, dismissing the lawsuit on that ground (on November 10, 2022). 2022 WL 16857051. The plaintiff appealed to the Ninth Circuit. After a prolonged appeals process, the Ninth Circuit overturned the district court’s decision on June 27, 2024. In a 2-1 decision, the Ninth Circuit held that 42 U.S.C. § 1981 prohibits employers from discriminating against United States citizens because an employer that does so gives one class of people—noncitizens—a greater right to make contracts than “white citizens.” 105 F.4th 1179.

After the Ninth Circuit’s decision, the litigation resumed. On September 4, 2024, two additional plaintiffs joined the lawsuit. They asserted allegations similar to the first plaintiff, claiming that they applied for multiple job openings at Meta, but that Meta did not hire them because they were U.S. citizens. On October 4, 2024, Meta again filed a motion to dismiss the lawsuit, this time arguing that even if Meta did discriminate on the basis of citizenship, the plaintiffs did not allege facts showing that, but for Meta’s purported discrimination, Meta would have hired them over other qualified candidates.

This time around (on February 25, 2025), the district court denied Meta’s motion to dismiss, holding that the plaintiffs’ allegations (specifically, the plaintiffs’ personal anecdotes from their interviews, the statistical evidence the plaintiffs offered, and the DOJ investigation the plaintiffs pointed to), if proven true, were sufficient to plausibly infer that Meta’s had a practice of discriminatory hiring—which is all the plaintiffs needed to prove to prevail.

Litigation again resumed and—on March 25, 2025—two additional plaintiffs joined the lawsuit. One alleged he worked for Meta as contractor from August 2023 to August 2024, but that Meta did not retain him as a permanent employee because he was a U.S. citizen. With this addition to the lawsuit, the plaintiffs’ putative class expanded to include “All individuals who are not visa holders [and] who were employed by Facebook and/or Meta in the U.S., either directly or through a third-party vendor . . . and were terminated.”

As of April 19, 2025, the litigation is ongoing.
