This case challenges alleged discrimination against white, heterosexual, male academics in hiring decisions by Northwestern University School of Law and in the selection of articles for the Northwestern University Law Review.

On February 1, 2025, Faculty, Alumni, and Students Opposed to Racial Preferences (FASORP), a non-profit organization, filed this lawsuit in the U.S. District Court for the Northern District of Illinois. FASORP sued Northwestern University, the dean of the Northwestern University Pritzker School of Law and three of its professors, and the editor-in-chief and the senior equity and inclusion editor of the Northwestern University Law Review under Title VI, Title VII, Title IX, and 42 U.S.C. § 1981. Represented by the America First Legal Foundation and private counsel, FASORP asserts organizational standing on behalf of three unnamed white male professor members who claim they are ready to apply for jobs at Northwestern but are denied an equal opportunity to compete, and it seeks broad declaratory and injunctive relief, including colorblind/sex-neutral hiring and selection policies, court monitors, and an order barring Northwestern from receiving federal funds until it eliminates the alleged preferences. FASORP originally filed a lawsuit in the same court against the same defendants on July 2, 2024, but it voluntarily dismissed that lawsuit on January 31, 2025 before refiling the next day in order to add a Title VII claim. (Case No. 1:24-cv-05558.) The present case was assigned to Judge Sara L. Ellis, who also heard the original 2024 case. 

FASORP alleged that Northwestern’s law school had a standing policy of rejecting qualified white, heterosexual, cisgender men for faculty appointments and instead gave unfair preferences to “black, Hispanic, Asian, female, homosexual, and transgender faculty candidates” whom the plaintiff claimed were unqualified. FASORP also alleged that the editors of the Northwestern University Law Review similarly discriminated against white, male academics in their selection of articles and in the appointment of student editors. The complaint asserted that the administration of Northwestern University Pritzker School of Law exerted pressure on the school’s hiring committee to accept “less-qualified” minority professors, threatened to withhold bonuses to coerce favorable faculty votes, and “rigged” its 2022 search for a new dean to guarantee that the new appointee would be a woman. It further alleged that the university tolerates extensive plagiarism by certain Black faculty. FASORP also claimed that Northwestern Law Review uses personal statements, an equity and inclusion editor, and NDAs to conceal discriminatory selection of members, editors, and articles. It cited an issue of the Law Review that contained articles exclusively written by Black women as further evidence of discrimination. 

Because the new lawsuit contained substantially the same claims as the one originating in 2024 that the plaintiff voluntarily dismissed, the defendants filed a motion for the plaintiff to pay their attorneys’ fees from the original lawsuit. On May 28, 2025, Judge Ellis ruled that the plaintiff’s counsel had unnecessarily delayed the case and imposed additional cost on the parties by dismissing the original lawsuit, but because the work that the defendants’ counsel had done during the original case remained useful, the plaintiff only had to pay the costs related to the motion seeking attorneys’ fees itself, subject to mutual agreement on what a reasonable payment would be. The parties indicated in a joint statement filed on August 22, 2025 that they were not able to agree on a reasonable payment.

On January 22, 2026, Judge Ellis granted the defendants’ motion to dismiss all of FASORP’s claims. Judge Ellis ruled that FASORP lacked standing to bring its claims about Northwestern Law’s entry-level faculty hiring and internal promotion because none of FASORP’s members were entry-level academics who were ready and able to apply for faculty positions at Northwestern. Judge Ellis also ruled that the plaintiff lacked standing to bring its claims about Northwestern Law Review’s student editor and article selection process. None of FASORP’s members were students who sought editor positions at Northwestern Law Review, and the plaintiff did not make any factual claims about ongoing discrimination beyond the existence of a “senior equity and inclusion editor” role and the fact that one issue of the Law Review only contained articles written by Black women. Judge Ellis then dismissed FASORP’s claims about Northwestern Law’s lateral hiring practices for failure to state a claim. She ruled that Title VI only reaches employment discrimination when employment is the primary objective of federal funding or the alleged discrimination necessarily harms the primary beneficiaries of the funding, neither of which apply in the case of Northwestern’s research funding. The Title VII and § 1981 claims failed because FASORP only alleged that heterosexual, white, male applicants received a competitive disadvantage, and did not claim that Northwestern actually took any adverse employment action. The plaintiff agreed to dismiss its Title IX claim against Northwestern after conceding that Seventh Circuit precedent bars simultaneous claims for gender-based employment discrimination under Title VII and Title IX. FASORP also did not challenge the defendants’ argument that Title VI and Title IX claims cannot be brought against individual defendants. 2026 WL 252514.

On February 14, 2026, FASORP appealed the dismissal of its complaint to the U.S. Court of Appeals for the Seventh Circuit.
