This case challenged Executive Order No. 14343, issued by President Donald Trump on August 28, 2025. The order is a follow-up to Executive Order 14251, which excluded numerous agencies and subdivisions—designated as having primary national security functions—from the collective bargaining protections afforded under the Federal Service Labor-Management Relations Statute and the Foreign Service Labor-Management Relations Statute (collectively, the FSLMRS). Executive Order 14343 excluded six additional agencies, including the United States Agency for Global Media (USAGM), from labor coverage under the FSLMRS. In connection with EO 14343, on August 29, 2025, the USAGM informed Plaintiffs that it was terminating its collective bargaining agreements (CBAs) with them. Similar cases challenging Executive Orders 14251 and 14343 are collected here

On September 19, 2025, American Federation of State, County & Municipal Employees, AFL-CIO (“AFSCME”) and American Federation of Government Employees, AFL-CIO (“AFGE”), along with their affiliated local unions, filed this lawsuit in the U.S. District Court for the District of Columbia against President Donald Trump, the USAGM, and Special Advisor to USAGM Kari Lake. Plaintiffs, the designated collective bargaining representatives for USAGM employees, alleged that defendants’ actions violated the First and Fifth Amendments and were ultra vires. Specifically, Plaintiffs asserted that EO 14343 (i) was issued in retaliation for their protected speech and petitioning activities, in violation of the First Amendment, and (ii) exceeded the President’s authority under 5 U.S.C. § 7103(b). Plaintiffs further asserted that the USAGM’s termination of the CBAs pursuant to EO 14343 (i) constituted similar First Amendment retaliation, and (ii) violated the Fifth Amendment by depriving them of constitutionally protected property interests and abrogating property rights in those agreements without due process. Plaintiffs sought a declaratory judgment, injunctive relief, and attorney’s fees. The case was assigned to Judge Paul L. Friedman. 

Also on September 19, 2025, Plaintiffs filed a motion for a preliminary injunction seeking to enjoin Defendants from enforcing or otherwise carrying out Sections 1 and 2 of Executive Order 14343 as they pertain to Plaintiffs’ bargaining units at USAGM and all employees within those units. Defendants were directed to file their motion in opposition by October 31, 2025. 

On the same day, Plaintiffs filed a notice of related cases, asserting that their case involved a common issue of fact and arose from the same event or transaction as nine other cases: Widakuswara v. Lake, 1:25-cv-01015 (D.D.C.); NTEU v. Trump, No. 1:25-cv-00935 (D.D.C.); AFGE v. Trump, No. 3:25-cv-03070 (N.D. Cal.); Am. Foreign Serv. Ass’n v. Trump, No. 1:25-cv-01030 (D.D.C.); Fed. Educ. Ass’n v. Trump, No. 1:25-cv-01362 (D.D.C.); AFL-CIO v. Trump, No. 1:25-cv-02445 (D.D.C.); Nat’l Ass’n of Agriculture Employees v. Trump, No. 1:25-cv-02657 (D.D.C.); Nat’l Weather Serv. Emps Ass’n v. Trump, No. 1:25-CV-02947 (D.D.C.); and NTEU v. Trump, No. 1:25-cv-02990 (D.D.C.). 

On October 7, 2025, the court denied the defendants' objection to the notice of relatedness. Citing its recent decision in Am. Fed’n of Labor-Congress of Indus. Orgs. v. Trump, No. 25-02445 (WL 2301989), the court found that all cases before it challenging Executive Orders 14251 and 14343 are related, as they (1) raise common factual issues and (2) arise from the same underlying event or transaction. The court concluded that the present case is related to each of the cases listed in the plaintiffs’ notice of related cases, except that Widakuswara v. Lake, 1:25-cv-01015 (D.D.C.) and AFGE v. Trump (3:25-cv-03070 N.D. Cal.) were not included in the court's order.
