On July 23, 2026, a former immigration judge filed this lawsuit against the Department of Justice and the Acting Attorney General. She had spent fifteen years representing noncitizens before joining the Executive Office for Immigration Review in 2023, but the Department declined to convert her probationary appointment to a permanent one and terminated her in September 2025. The plaintiff said that she had exceeded her case completion targets and received the highest available ratings, but that other judges who were not converted around the same time were overwhelmingly women, people of color, and lawyers who had previously advocated for immigrants, while white male judges were not terminated.
