Case Summary

The EEOC's Detroit office filed this suit on August 22, 2003 in the U.S. District Court for the Eastern District of Michigan, Detroit Division. The suit alleged that defendant Nabi Biopharmaceuticals violated the ADA by failing to rehire a complainant with renal failure after her medical leave ended. A trial date was set two months after filing, but the date was pushed back three times, as stipulated by the parties. Finally, on February 11, 2005, a settlement agreement was signed by the judge, ending the suit. In the agreement, Nabi agreed to pay $26,500 and end its policy of firing employees at the end of their medical leave. The defendant also agreed to post notice of Equal employment opportunity laws and provide training for management, supervisory, and human resources officials. The settlement term was 3 years. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
