In June 1997, the San Antonio office of the EEOC brought this Title VII suit against Youth Care Foundation, Inc. d/b/a Bear Creek Ranch in the U.S. District Court for the Western District of Texas. The complaint alleged that the defendant subjected the claimants and other females to a hostile environment because of their sex, discharged females because of their sex, and retaliated against female employees who complained. The parties settled by entry of a consent decree in October 1997, and it was amended in December 1997.
The five year consent decree required the defendant to pay the claimants $15,000, refrain from discrimination, retaliation, and harassment, make an offer of reinstatement to the claimants, draft and implement an anti-harassment and anti-retaliation policy, train supervisors, managers, officers, directors, and any individuals designated for reports of sexual harassment, post notice, expunge the claimant's records, provide claimants with a positive reference, and apologize to the claimants.
