In September 2002, the EEOC district office in Detroit, Michigan brought this suit against Speedway SuperAmerica, LLC in the U.S. District Court for the Eastern District of Michigan. The complaint alleged violations of Title VII of the Civil Rights Act of 1964 based on race discrimination. After the defendant filed its initial answer and affirmative defenses, the case was settled and a consent decree was entered in August 2003.
In the consent decree, the parties agreed that the defendant would pay the aggrieved parties $150,000, provide fourteen sales jobs to fourteen of the aggrieved employees, refrain from retaliating or discriminating on the basis of race, and post EEO notices. $500 in fees was awarded to the EEOC. $1100 in fees for review of the payment of damages was awarded to the aggrieved individuals to be divided evenly. The terms of the agreement ran for one year.
