In August 2000, the EEOC district office in Phoenix, Arizona brought this suit against the Primary Limited Corporation, doing business as Primary Electric, in the U.S. District Court for the District of Arizona. The complaint is currently unavailable. In April 2001, the presiding judge scheduled a hearing for the EEOC to show why he should not dismiss the case for lack of cause. Apparently the EEOC had failed to serve Primary Limited with the complaint. Two weeks before the hearing, the EEOC entered a notice of dismissal without prejudice. The court vacated the order for a cause hearing and the case was closed in June 2001.
