Case Summary

In July 2003 the Atlanta District Office of the EEOC brought this lawsuit against Cagle's Inc. in the U.S. District Court for the Middle District of Georgia alleging sexual harassment and retaliation in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendants permitted the sexual harassment of the complainant, a female employee, and committed some act of retaliation. The complainant intervened in the lawsuit in September 2003. Following some discovery, the defendant's motion for summary judgment was granted in February 2005 and denied the EEOC's motion to reconsider this judgment in February 2005. The intervenor plaintiff appealed the District Court's summary judgment decision in March 2005, and the EEOC appealed the District Court's refusal to reconsider the judgment in April 2005. The Eleventh Circuit affirmed the District Court's findings in April 2005.
