In November 1998, the Indianapolis Office of the EEOC filed this lawsuit against SWP, Inc., doing business as Superior Wood Products, in the U.S. District Court for the Northern District of Indiana alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. The case was tried by a jury in February-March of 2000 with the jury returning a verdict in favor of the plaintiffs. The court entered judgment for the plaintiffs in March 2000, requiring the defendant to pay $75,000 in compensatory damages and $115,000 in punitive damages, where the punitive damage award was reduced by $25,000 to conform with 42 U.S.C. ß1981a(b)(3). RBK Development, Inc. was joined to the case following its purchase of SWP, Inc's assets in a "friendly foreclosure proceeding" found by a magistrate judge to have been an attempt to evade the jury's sexual harassment judgment against SWP, Inc.
