On February 12, 1998, the United States filed a lawsuit against the Florida Department of Corrections under 42 U.S.C. § 2000e, et seq. ("Title VII") in the U.S. District Court for the Southern District of Florida. The United States, along with the individual plaintiff, sought injunctive and monetary relief, alleging that the defendant violated Title VII, by discriminating and retaliating against a female employee on the basis of gender.

The plaintiff alleged that the female prison teacher was subjected to a sexually hostile work environment in the following ways: (1) conditioning the terms, conditions, and privileges of her employment upon the submission to unwelcome sexual advances of her immediate supervisor; (2) threatening to alter the terms, conditions, and privileges of her employment unless she assented to such unwelcome sexual advances; and (3) taking adverse action against her because of her opposition to those unwelcome sexual advances.

After the complaint was filed, the defendants moved to dismiss. However, before the court ruled on that motion, the parties stipulated to the dismissal of the case on June 16, 1998. The reason for that dismissal or the terms of any settlement agreement are not clear from the public docket.

The case is now closed.
