This case is a putative class action lawsuit filed by a former auto mechanic of the Fire Department of New York (FDNY) alleging discrimination against employees with a need to express milk during working hours. Plaintiff made claims against against the City of New York, FDNY, and several officials under Title VII (including the Pregnancy Discrimination Act), § 1983, and New York state law that Defendant did not provide reasonable accommodations (especially a clean and private place to pump) and created a hostile work environment (including disparate treatment and retaliation). The putative class included all female employees of FDNY since 2007 who had the need or chose to express milk at work. Plaintiff was represented by private counsel and filed the complaint on April 10, 2020, in the U.S. District Court for the Eastern District of New York. Plaintiff sought injunctive relief to rewrite reasonable accommodation policies regarding lactation, compensatory and punitive damages, and attorneys’ fees.

Judge Ann M. Donnelly initially sent the case to mediation, but the parties were unable to reach an agreement. After a lengthy discovery process, Plaintiff filed for class action certification on August 21, 2022. On April 12, 2023, Judge Donnelly adopted Magistrate Judge Peggy Kuo’s recommendation of March 24, 2023 (2023 WL 2918861) that the class certification be denied because Plaintiff failed to prove a systemwide practice of pervasive discrimination. Defendants showed that 91 employees had requested lactation accommodation in the previous decade and no other complaints had been registered.

The court then requested pre-motion letters in anticipation of a motion for summary judgment. After Defendants were granted several deadline extensions, Plaintiff moved to voluntarily dismiss the claims with prejudice. Judge Donnelly granted the dismissal on January 26, 2024. The case is now closed.

Minute Entry for proceedings held before Magistrate Judge Peggy Kuo. A telephone status conference was held on February 19, 2021. No appearance on behalf of Plaintiff. Attorneys Joseph Anci and Kami Barker appeared for the City Defendants. Attorney James Kimmel appeared on behalf of Defendants Morbelli and McAllister. Chambers staff and Defense counsel attempted to contact Attorney Eric Sanders to remind him of the conference call but were unable to reach him before the conference concluded. Messages were left for him to call into the conference. Counsel for all defendants indicated that Plaintiff has not made any settlement demand. A settlement demand was due November 16, 2020. Ms. Barker indicated that she had asked Plaintiff's counsel to provide a demand even after that date, and received no response. The Court informed counsel that it was concerned about whether the settlement conference should go forward on February 24, 2021, given that Plaintiff's counsel stated in an email to the Court that, "At this point, it would be a waste of the Courts and the parties time to have a settlement conference." Because Plaintiff's counsel failed to appear at the conference, no information was provided about the basis for Plaintiff's counsel's belief. The Court notes that Plaintiff joined in the request of January 14, 2021 51 that the Court schedule a settlement conference and did not object to it being scheduled for February 24, 2021. Plaintiff's counsel was also unavailable to explain why he has not responded to defense counsels requests for demands, why he failed to comply with the Court's deadline that he provide demands by November 16, 2020, why he has not provided the information required in the ex parte settlement statements, and why he failed to provide the required settlement statement by February 16, 2021, other than his statement, "Im on vacation." The settlement conference is adjourned sua sponte. Instead, a status conference by telephone is scheduled for February 24, 2021 at 2:15 p.m.. All counsel must appear. Plaintiff's counsel must show cause for his repeated failures to comply with Court orders, including attendance at today's conference.
